STAFF REPORT: Petition No. 8501 Item No.3 A-1EX to A-B <br /> Public Hearing Date: 8/27/2002 Stoflet et al. & Keltz, owners <br /> Work Meeting Date: 9/10/2002 Cottage Grove, Section 31 <br /> I. BACKGROUND <br /> Elizabeth(Liza)Lightfoot owns 63.25 acres,with approximately 2 acres zoned LC-1 under Pet. 6793. <br /> (See HISTORY, below.) Ms. Lightfoot wishes to rezone a 3.0-acre area(not a separate parcel)along her <br /> Siggelkow Road frontage to A-B Agriculture Business to permit a"farm market" for"sales and <br /> distribution of nursery stock and plants"as permitted in A-B (DCCO Sect. 1.121(1)(f).) She describes <br /> her proposed use as"retail sale of nursery stock, cut flowers, stems, organic produce, gourds, pumpkins, <br /> pots and related items such as topsoil, mulch, organic fertilizers and products... maintain[ing] the rural <br /> nature and atmosphere of the area. This would be a new division of Avant Nurseries and would provide a <br /> source of income that would help to sustain the present business and its current employees." <br /> Avant Gardening was"planning to proceed with the Roadside Stand...[and has] installed a well, <br /> electrical service,fence and done extensive preparation." The site plan submitted for the farm stand (see <br /> attached)shows a new entrance onto Siggelkow Road, 6 parking stalls, prairie plantings along the road <br /> right-of-way, landscape displays, a gazebo overlooking a pond, screening along the West and Southwest <br /> sides of the farm stand area, and portable sanitary facilities. Hours for the A-B operation would be 10 <br /> a.m. —6 p.m. Tues.-Sun. <br /> Soils: 100% Class I-II <br /> Uses: 100% Cropland <br /> HISTORY: <br /> 02/05/1997 Pet. 6793 Ms. Lightfoot rezoned a 1.57 acre area(not a separate parcel)of A-1EX land to <br /> LC-1 for her landscape contracting business, Avant Gardening, subject to the Condition that she follow a <br /> site plan submitted 01/07/1997. She obtained(3)zoning permits for a 40'x84' building, a 20'x60' <br /> storage building and a 10'x10' storage building in the LC-1 zoned area. <br /> Late 2001 --Ms.Lightfoot inquired about operating a roadside stand along the Sigglekow Road frontage <br /> as permitted in the A-1EX district. The definition of Roadside Stand is"A structure having a ground area <br /> of not over 200 square feet, not permanent by being attached to the ground, readily removable in its <br /> entirety and to be used solely for the sale of farm and garden products produced on the premises. Such <br /> structures may be located within the setback lines of roads but shall not interfere with visibility along the <br /> highway."(Section 10.01(53)DCCO.) Ms. Lightfoot worked with Dane County Zoning to develop a <br /> plan to comply with these criteria, but"...after further discussion with the Zoning Administrator, it was <br /> determined that a rezone to A-B or C-1 zoning would be best." <br /> H. ANALYSIS <br /> A. Compliance with Adopted Plans <br /> • Town Land Use Plan <br /> • Map: The subject property is in the Agriculture District. The purpose of this district states: <br /> "Purpose: The Land Use Plan Map designates almost all of the area east and south of the Village <br /> of Cottage Grove for long-term agricultural use.
