It was explained that <br /> the deck was destroyed by a tree falling onto it as a result of a windstorm. <br /> As a result of the review process, we are unable to approve the permit and the <br /> application is hereby Denied. Below is a list of findings: <br /> o The applicant, Robert Blettner, and agent, Matthew Fortney, both provided <br /> information in an email or verbally that the sun porch was constructed <br /> approximately in 1978. In 1970, Shoreland regulations were adopted by Dane <br /> County requiring the structures of this sort be regulated. Under these regulations <br /> a permit would be necessary for the construction of this structure. No permit <br /> was produced by the applicant nor a permit found in Dane County records. <br /> o On September 17, 1970, Dane County adopted Shoreland regulations. Under <br /> the 1978 Dane County Code of Ordinance section 10.16(7), all buildings or <br /> structures shall be setback from the water at least 75 feet, with the exception of <br /> piers, hoists, and boathouses. Given that the deck was constructed in 1978 <br /> without a permit, the deck would be considered an illegal structure and would <br /> not be considered a non-conforming structure with replacement privileges. <br /> ❑ Any replacement of the structure will need to conform to current Shoreland <br /> Regulations as found under Dane County Code of Ordinance Section 11.03. <br /> This ordinance section only allows piers, boat hoists, and boathouses within 75 <br /> feet of the water's edge (Ordinary High Water Mark).
