❑ These rules have been adopted to limit structures by the water edge to protect
the natural beauty of lakes, rivers, and streams. However, there is an exception
for minor structures, which requires a minimum setback of 35 feet from the
water's edge.
Please be advised that the damaged deck that was proposed to be replaced is
considered an illegal structure. I trust that the unsafe, destroyed illegal structure will be
removed from the property to avoid enforcement action by Dane County Zoning
Division. Your cooperation will be appreciated in this matter.
If you feel aggrieved by the denial of the zoning application, an appeal of this decision
can be made to Dane County Board of Adjustment pursuant to Dane County Code of
Ordinance section 10.26(3) within 30 days of the date of this letter.
If you have any other questions or concerns, please give me a call at (608) 266-9078.
Respectfully,
Ro . Lane III
Dane County Zoning Administrator
Cc Tom Mistele, Aztec Builders
Matthew Fortney, Quarles & Brady LLP
210 Martin Luther King Jr.Blvd.❖Room 116,City-County Bldg.•Madison,WI 53703-3342•Phone:608.266.4266•Fax:608.267.1540
