Blettner Patio, 5120 St. Cyr Road, Middleton(town of Westport) Page 1 of 2
Lane, Roger
From: Bob Blettner[BobB @blettner.com]
Sent: Monday, August 11, 2008 3:50 PM
To: Lane, Roger
Subject: RE: Blettner Patio, 5120 St. Cyr Road, Middleton (town of Westport)
Dear Mr. Lane,
Thank you for your timely and detailed response. As you must have deduced, I have been getting a lot of"helpful" - perhaps
erroneous-advice from several sources. I will review Section 11.03 and comply with the law.
Thanks for your help.
Bob Blettner
From: Lane, Roger [mailto:lane.roger @co.dane.wi.us]
Sent: Mon 8/11/2008 2:38 PM
To: Bob Blettner
Cc: Jerry@hermanlandscape.com; Schutte, Kristine; Steinhauer, Charles; cami.peterson @wisconsin.gov; Bruskewitz, Eileen
Subject: RE: Blettner Patio, 5120 St. Cyr Road, Middleton (town of Westport)
Dear Mr. Blettner,
It is apparent that you wish to construct a man-made surface which would be directly adjacent to a waterway. This surface, as
explain in previous examples, would cover an area of 15'x 30'. It is clear to me that you are trying to construct an area for which
purpose is to be for the placement of a table and chairs for entertainment. Whether it would be made out of wood or brick pavers,
it would still be considered a patio deck.
The intent of Shoreland regulations is to keep the shoreline looking as natural as possible. The only structures allowed within the
75-foot setback are structures to facilitate the docking of boats (boathouse, piers, or boat hoist). The area is not intended to be
used for the placement of a patio deck for entertainment purposes. However, the shoreland regulations incorporate provisions for
minor structures by the shoreline but limiting them to 200 square feet with a setback of 35 feet minimum from the water's edge for
the enjoyment of the shoreline.
I would agree with Cami Peterson that stairways, and landings, would be exempt from shoreland regulations. But here again, it
would only be allowed to provide pedestrian access to the shoreline because of steep slopes and would be limited to a maximum
of 4 feet wide. There are no steep slopes on your property.
The creation of this patio deck within the 75-foot setback area would be considered to be in Violation of Dane County Code of
Ordinance Section 11.03. Citations would be issued for a violation of this nature until the area was brought back to a natural
state.
I do understand your interest in this project. The existing deck by the water side must have been a nice place to entertain. But
current regulations are designed to ensure that the natural areas in close proximity to lakes and streams stay as natural as
possible.
Respectfully,
Roger Lane
Dane County Zoning Administrator
Original Message
From: Bob Blettner [mailto:BobB @blettner.com]
Sent: Monday, August 11, 2008 12:19 PM
To: Lane, Roger
Cc: Jerry@hermanlandscape.com
8/11/2008
