It is clear to me that you are <br /> trying to construct an area for which purpose is to be for the placement of a table and chairs for entertainment. <br /> Whether it would be made out of wood or brick pavers, it would still be considered a patio deck. <br /> The intent of Shoreland regulations is to keep the shoreline looking as natural as possible. The only <br /> structures allowed within the 75-foot setback are structures to facilitate the docking of boats (boathouse, piers, or <br /> boat hoist). The area is not intended to be used for the placement of a patio deck for entertainment purposes. <br /> However, the shoreland regulations incorporate provisions for minor structures by the shoreline but limiting them <br /> to 200 square feet with a setback of 35 feet minimum from the water's edge for the enjoyment of the shoreline. <br /> I would agree with Cami Peterson that stairways, and landings, would be exempt from shoreland regulations. But <br /> here again, it would only be allowed to provide pedestrian access to the shoreline because of steep slopes and <br /> would be limited to a maximum of 4 feet wide. There are no steep slopes on your property. <br /> The creation of this patio deck within the 75-foot setback area would be considered to be in Violation of Dane <br /> County Code of Ordinance Section 11.03. Citations would be issued for a violation of this nature until the area <br /> was brought back to a natural state. <br /> I do understand your interest in this project. The existing deck by the water side must have been a nice place to <br /> entertain. The block being used <br /> is Unilock Eco-optilock which meets the LEED's certification for a permeable block. <br /> 8/11/2008 <br />
