Fortney <br /> Quarles & Brady LLP <br /> 33 E Main St <br /> PO Box 2113 <br /> Madison WI 53701-2113 <br /> RE: Deck at grade at 5122 St. Cyr Court <br /> Dear Mr. Fortney: <br /> Zoning Administrator Roger Lane referred the matter of the proposed reconstruction of the Bleifield deck <br /> to me. Because the deck is an illegal use in the Shoreland setback area, your clients' alternatives are <br /> as follows: <br /> 1) Remove the deck and replace it with a legal pier, boathoist or boathouse located near the water's <br /> edge as permitted under Dane County Zoning and Shoreland Ordinances. I would be glad to <br /> help the Bleifields and their contractor understand all the ordinance requirements relating to use, <br /> location, size and height restrictions for these permitted types of structures. <br /> 2) Remove the deck and replace it with a new legal deck located a minimum of 35 feet from the <br /> Ordinary High Water Mark (OHWM) as a "Minor Structure,” permitted under Section 11.03(5) <br /> Dane County Code of Ordinances (DCCO). In this case, the maximum size of the deck and any <br /> other minor structures located between the house and 35 feet from the OHWM is 200 square <br /> feet. Roger Lane explained this as Option 2 in his letter of July 3, 2007. A Zoning Permit must <br /> be obtained before construction may begin on any new Minor Structure. <br /> 3) Apply for a variance or variances to permit the reconstruction of the deck in its present location. <br /> Roger Lane explained this as Option 3 in his letter of July 3, 2007. I am attaching a variance <br /> application packet for your convenience. Please note that July 8, 2008 is the deadline for the <br /> next available Board of Adjustment Public Hearing, scheduled for August 28, 2008. The <br /> application fee is $350.00 (make check payable to Dane County Zoning, please). <br /> 4) Appeal the Zoning Administrator's decision to deny the Zoning Permit for replacement of the <br /> destroyed,deck to the Dane County Board of Adjustment. Roger Lane mentioned this alternative <br /> in his letter of May 27, 2008. Please be advised that such an appeal must be filed within 30 days <br /> of the Zoning Administrator's decision, or no later than June 26, 2008. Please see the attached <br /> copy of the Rules and Procedures of the Dane County Board of Adjustment, effective 01/17/2008, <br /> for more information about an "appeal of an administrative decision.
