If they choose removal, they <br /> must contact the Dane County Land Conservation Division at 224-3730 regarding any <br /> requirement for a Shoreland Erosion Control Permit. <br /> I must point out that the "permeability" of the proposed replacement deck, as described in your letters to <br /> Roger Lane dated June 16 and 17, 2008, is immaterial to whether or not the existing deck may be <br /> removed, replaced, repaired or restored. <br /> A more important consideration is the probable location of the existing deck in the 100-Year Floodplain of <br /> Lake Mendota. If a variance were granted to allow reconstruction of the deck, the new deck would need <br /> to comply with all provisions of Chapter 17 -- Floodplain Zoning of the Dane County Code of Ordinances. <br /> A topographic survey to identify the location of both the 100-Year Floodplain Elevation (852.0 Feet <br /> Above Mean Sea Level) and the Ordinary High Water Mark Elevation (850.7 Feet Above Mean Sea <br /> Level) would be required. <br /> As Assistant Zoning Administrator, I staff the Dane County Board of Adjustment.
