Dane County Board of Adjustment Minutes Page 5 of 11 <br /> Ap26,2007 Public Hearing <br /> Operations/Public Safety...at least three business days prior to the initial date it proposes to <br /> operate the crane at a height exceeding the limits of the HLZO and shall provide the anticipated <br /> day(s) and hours of operation of the crane. <br /> • Selmer Company will also provide the Airport with a point of contact for someone who will be at <br /> the construction site during all periods of crane operation and has the authority to direct the <br /> lowering of the crane. <br /> • The crane must be lowered to the ground or below the existing tree line when not in use and <br /> during the hours between sunset and sunrise. <br /> • During operation, the highest point of the crane must be marked with an orange and white <br /> checkered construction flag, in accordance with FAA Advisory Circular 70/7460=1K Change 2. <br /> Crane operations are limited to daylight hours only. <br /> • In accordance with the FAA air space analysis, the crane shall not exceed 120 feet above ground <br /> level (AGL). <br /> VARIANCES REQUESTED: <br /> Needs variance of 59 feet above maximum permitted height shown on the official Dane County Height <br /> Limitation Zoning Ordinance map (120 proposed crane height -61 feet height permitted under HLZO). <br /> IN FAVOR: Amos Wilde, New London, WI for The Selmer Company <br /> OPPOSED: None <br /> MOTION: Long/Reynolds to grant a variance of 59 feet from maximum allowable height of a structure <br /> permitted within the Dane County Regional Airport Height Limitation Zone to allow temporary <br /> construction crane, with five (5) Conditions as listed in the 03/19/2007 letter from Marty Lenss, Dane <br /> County Regional Airport Director of Operations/Public Safety. <br /> Finding of Fact: <br /> 1. The Selmer Company is the contractor for a three-story addition to the east side of an existing <br /> building on the Madison Area Technical College Campus at 3502 Anderson Street (intersection <br /> with US Highway 51) in the City of Madison. The addition will not exceed the HLZO maximum <br /> height. <br /> 2. A telescopic construction crane is needed between May 1 and September 30, 2007 to complete <br /> this project. <br /> 3. Maximum height allowed by the Dane County HLZO in this "cell' is 61 feet. <br /> 4. The proposed crane has received FAA"Determination of No Hazard to Air Navigation" effective <br /> through August 13, 2007 " unless...extended, revised or terminated by the issuing office." <br /> Conclusions: <br /> 1. Unnecessary Hardship: Lack of a variance would unreasonably prevent the permitted use of the <br /> property. <br /> 2. Unique Physical Limitations: The property is located in the Dane County Regional Airport Height <br /> Limitation Zone. <br /> 3. No Harm to Public Interests: Compliance with the Conditions of the Airport Operations/Public <br /> Safety Director serves the public interest. <br /> Motion carried: 4—0. <br /> 5. Appeal #3468. Appeal by Alan Carlson and Karen Carlson for variances from minimum required <br /> lot width and minimum required lot area in the Shoreland District, and for minimum setback from <br /> road and maximum permitted area of residential accessory building in the R-3 district, as provided <br /> by Sections 11.03(1), 10.05(4)(b), 10.17(4) and 10.04(1)(b), Dane County Code of Ordinances, to <br /> bring three existing substandard lots into zoning compliance and to permit existing detached <br /> garage on a lot without a principal residential use on property located at, West of and across from <br />
