contained in the by-laws and any rules and regulations adopted by the Prairie Park at <br />Swan Creek Unit Owners Association, Inc., a Wisconsin non -stock corporation (the <br />"Association") from time to time, and in any and all amendments and modifications <br />thereto as adopted by the Association from time to time. <br />ARTICLE III <br />UNITS <br />3.1 Definition. "Unit" shall mean a part of the Condominium intended for any <br />type of independent use, including one or more cubicles of air at one or more levels of <br />space or one or more rooms of enclosed space located on one or more floors (or parts <br />thereof) in a building, some of which spaces may be non-contiguous, as more particularly <br />described and depicted in the Condominium Plat. <br />3.2 Boundaries of Residential Units. A Residential Unit in the Condominium <br />shall include one (1) or more contiguous or non-contiguous cubicles of air, including the <br />perpetual right of ingress thereto and egress there from located within the boundaries <br />described below (except as otherwise expressly provided herein): <br />A. The exterior boundaries of the cubicles that constitute Residential <br />Units shall be the vertical or horizontal planes, the elevations of which coincide with and <br />include the following: (i) for the walls, the innermost plane of the unfinished drywall, <br />plaster, or other material affixed to the masonry or stud walls, but including the finished <br />surface of the drywall, plaster or other material affixed to the masonry or stud walls; (ii) for <br />the floor, the uppermost plane of the concrete floor or wood subfloor; and (iii) for the <br />ceiling, the lowermost plane of the drywall, plaster or other material that constitutes the <br />unfinished structural ceiling, excluding the drywall, plaster or other material affixed to the <br />structural portion of the ceiling. The foregoing boundaries extended to the intersection <br />with each other shall constitute the Residential Units as shown on Exhibit "B". It is <br />intended that the surface of each plane described above (be it tiled, papered, paneled, <br />painted, carpeted or otherwise covered) is included as a part of each defined Residential <br />Unit. However, the studs and drywall of Unit boundary walls are not a part of each defined <br />Residential Unit. Included within the Residential Unit shall be all doors, with the exception <br />of exterior doors and the doors to common hallways, which shall be Limited Common <br />Elements as defined below. Included within each Residential Unit shall be all interior <br />partition walls (including the studs and drywall for such interior partition walls) not shared <br />with any other Unit and interior doors. The Residential Units may be designated simply as <br />a "Unit" or as "Units" on the Condominium Plat. <br />B. In addition, a Residential Unit shall include any and all appliances <br />and other fixtures contained within or serving each Residential Unit, whether they are <br />inside or outside the defined cubicle of air, including, without limitation: <br />1) Interior lights and light fixtures, including the wiring therefore. <br />2) Cabinets. <br />2-5 <br />
