Declarant, Association and the owners and occupants of adjacent Storage Areas to <br />access such Storage Areas over and across any adjacent Parking Stalls. <br />5.3 Use and Maintenance. Except as otherwise provided herein, the manner of <br />use of the Limited Common Elements shall be determined solely by the Unit Owner who <br />has the exclusive use of such Limited Common Elements, except that no use may occur <br />which could damage the structure of any building, violate the terms and conditions of the <br />approved zoning text for the Condominium or otherwise cause harm to the Condominium <br />or violate the rules and regulations of the Condominium, as adopted or amended from <br />time -to -time. In addition, maintenance, repair and replacement of the Limited Common <br />Elements shall be the responsibility of the Unit Owner to whose use the Limited Common <br />Element is limited, except for that portion of the Limited Common Elements that are a part <br />of the exterior of the structure comprising the Condominium or otherwise visible to other <br />Unit Owners or the general public (including (i) all exterior doors and doors leading to <br />common hallways; (ii) all patios and balconies, including all water repelling membranes <br />and pavers on any patio or balcony located in the Condominium; (iii) windows and <br />skylights serving each Unit; (iv) the mailbox serving, and reserved for the exclusive use of, <br />each Unit; and (v) the Parking Stalls), repair, replacement and exterior cleaning of which <br />(including the choice of material, color and finish on all surfaces exposed to the general <br />public or other Unit Owners) shall be the responsibility of the Association and the cost of <br />which shall be a Common Expense as set forth in Article XIV below. Improvements to <br />Limited Common Elements, as contemplated by Section 703.13(5m) of the Act, are <br />hereby prohibited, and any improvements to the Limited Common Elements shall be <br />governed strictly by the terms and conditions of this Declaration. <br />ARTICLE VI <br />USES <br />6.1 General. The Units, Limited Common Elements, and Common Elements of <br />the Condominium shall be used for residential occupancy, vehicular driving and parking <br />purposes and pedestrian use only, as appropriate, and shall not be used for any other <br />purpose. <br />6.2 Zoning Text. Occupancy of the Residential Units shall be governed by the <br />zoning text approved by the City of Fitchburg for the Condominium, which, in general, <br />provides for residential occupancy. <br />6.3 Municipal Ordinances and Rules and Regulations. The use of the Units, <br />Limited Common Elements, and Common Elements shall comply with the City of <br />Fitchburg General Ordinances, any other applicable municipal or governmental rules, <br />regulations or ordinances, and any other restrictions as contained in the Association's <br />Articles of Incorporation, by-laws and any rules and regulations adopted by the Association <br />from time -to -time and as such may be amended from time to time. <br />6.4 Use and Enjoyment, Storage of Materials, Insurance Rates and Nuisance. <br />No use may unreasonably interfere with the use and enjoyment of the Common Elements <br />2-12 <br />
