regulations adopted by the Association, or any portion thereof, shall be determined to be <br />invalid by a court of competent jurisdiction, the remaining provisions and portions thereof <br />shall not be affected thereby. <br />20.5 Conflict in Condominium Documents. In the event a conflict exists among <br />any provision of this Declaration, the Articles of Incorporation, the By -Laws, or any rules <br />and regulations, or between or among any of them, this Declaration shall be considered <br />the controlling document. <br />20.6 Lease of Units. <br />A. Definitions. The following terms, as used in this Section 20.6, shall <br />have the following definitions: <br />1) "Condominium Instruments" means this Declaration, the <br />Condominium Plat and the Association's Articles of Incorporation, by-laws and any rules <br />and regulations adopted by the Association, from time to time. <br />2) "Occupancy Agreement" means any lease or other <br />agreement for the use or other occupancy of a Unit by and between a Unit Owner and a <br />person (whether one or more) or entity, which person or entity is not a Unit Owner. <br />3) "Occupant" means any person or entity that uses or <br />occupies a Unit pursuant to an Occupancy Agreement. <br />B. Statement of Purpose. The Condominium is intended to be an <br />owner -occupied condominium community. A Unit Owner shall be permitted to enter into <br />an Occupancy Agreement for all or a portion of the Unit Owner's Unit, provided the Unit <br />Owner and Occupant (i) comply with all of the terms and conditions of this Section 20.6. <br />In order to promote owner -occupancy of Units in the Condominium and to preserve <br />preferred financing options for Unit Owners, the Association shall have the power and <br />authority to make rules and regulations limiting the total number of Units in the <br />Condominium that may be leased pursuant to Occupancy Agreements or otherwise. <br />C. Occupancy Agreements Must Be In Writing. All Occupancy <br />Agreements must, without exception, be in writing. <br />D. Compliance with Condominium Instruments. All Occupancy <br />Agreements shall provide that by entering into an Occupancy Agreement for a Unit in <br />the Condominium, the Occupant acknowledges receipt of, and agrees to be bound by <br />and observe, all of the terms and conditions of the Condominium Instruments. <br />E. Term Limits. The term of the Occupancy Agreement may not <br />exceed twelve (12) months in duration, unless a term of greater than twelve (12) months <br />is approved, in writing, by the Board of the Association. <br />2-27 <br />
