AMENDMENT NUMBER FOUR TO DECLARATION OF CONDOMINIUM OF PRAIRIE <br />PARK AT SWAN CREEK CONDOMINIUM <br />This Amendment Number Four to Declaration of Condominium of Prairie Park at <br />Swan Creek Condominium (the "Fourth Amendment") is made by Capitol Housing II, <br />LLC, a Wisconsin limited liability company ("Declarant"). <br />WITNESSETH: <br />WHEREAS, Declarant is the named Declarant for the Prairie Park at Swan Creek <br />Condominium (the "Condominium") located in the City of Fitchburg, Dane County, <br />Wisconsin, legally described in Exhibit "A", attached hereto and incorporated herein by <br />reference (the "Property"); and <br />WHEREAS, the Condominium was created by that certain Declaration of <br />Condominium of Prairie Park at Swan Creek Condominium dated June 6, 2006 and <br />recorded with the Dane County Register of Deeds on June 7, 2006 as Document No. <br />4199904 (the "Original Declaration"), which Original Declaration was amended by that <br />certain Amendment Number One to Declaration of Condominium of Prairie Park at <br />Swan Creek Condominium dated May 16, 2007 and recorded with the Dane County <br />Register of Deeds on May 18, 2007 as Document Number 4310769 (the "First <br />Amendment"), as further amended by that certain Amendment Number Two to <br />Declaration of Condominium of Prairie Park at Swan Creek Condominium dated May 4, <br />2009 and recorded with the Dane County Register of Deeds on May 15, 2009 as <br />Document Number 4546726 (the "Second Amendment"), as further amended by that <br />certain Amendment Number Three to Declaration of Condominium of Prairie Park at <br />Swan Creek Condominium dated April 10, 2015 and recorded with the Dane County <br />Register of Deeds on April 13, 2015 as Document Number 5142490 (the "Third <br />Amendment") (collectively, the Original Declaration, First Amendment, Second <br />Amendment and Third Amendment shall be referred to herein as the "Declaration"); <br />and <br />WHEREAS, Article XV of the Declaration permits the Declarant to unilaterally <br />amend the Declaration and the Condominium Plat to document any changes in the <br />Condominium or any Units, Common Elements or Limited Common Elements as <br />actually constructed, from that described in the Declaration and Condominium Plat; and <br />WHEREAS, Declarant desires to amend the Declaration and Condominium Plat <br />to document changes to certain Parking Stalls and Storage Areas as actually <br />constructed from that described in the Declaration and Condominium Plat. <br />NOW, THEREFORE, in consideration of the foregoing recitals, and other good <br />and valuable consideration, the receipt and sufficiency of which is hereby <br />acknowledged, it is agreed by and between Assignor and Assignee as follows: <br />1) Condominium Plat. As used in the Declaration, the term "Condominium <br />Plat" shall mean and refer to the Prairie Park at Swan Creek Condominium — <br />2 <br />
