AND WHEREAS, GOTTFRIED WALTERSCHEIT, contemplates in the future platting the unplatted portion or parts thereof of the prem- ises first above described and refraining from selling any part of the unplatted part of the first above described parcel by metes and bounds for building purposes or with residences located thereon unless the same is platted and said plat recorded in the office of the register-of deeds subject to the restrictions hereinafter set forth. NOW, THEREFORE, said GOTTFRIED WALTERSCFTEIT, hereby de- clares that all of the lots in the said plat of Olbrich Park'Addi- tion hereinbefore described, be and the same hereby are subject to the following: PROTECTIVE COVENANTS These Covenants are to run with the land and shall be bind- ing on all parties and all persons claiming under them until January 1, 1967, at which time said Covenants shall be automatic- ally .extended for successive periods of 10 years unless by vote of a majority of the then owners of the lots it is agreed to change said covenants in whole or in part, If the parties hereto, or any of . thei, or their heirs or assigns shall violate or attempt to violate any of the Cov- enants herein it shall be lawful for any other person or persons owning any real property situated in said develop- ment or subdivision to prosecute any proceedings at law or in equity against the person or persons violating or attemp- ting to violate any such Covenant and either to prevent him or them from so doing or to recover damages or other dues for such violation. Invalidation of any one of these Covenants by judgment or court order shall in no wise- affect any of the other provisions which shall remain in full force and effect.
