The Conditional Use Permit shall be for a <br /> period of time as stated in the application or as modified by the feunty Bening Committee, <br /> Modification of the application or reclamation plan may be permitted or additional conditions <br /> may be required upon application. The eeunty Bening Committee shall consider the effect of <br /> the proposed operation and the proposed reclamation upon existing and future conditions, in- <br /> cluding streets, neighboring land development, land use drainage, water supply, water pollu- <br /> tion, air pollution, soil erosion, natural beauty and land value of the locality. The eeenty <br /> Bening Committee may approve, approve conditionally or reject the application and reclamation <br /> plan. <br /> 29. Amend ss 10.126 (2) (a) 5. to read as follows: <br /> 5. Create a new ss 10.126 (2) (a) 6. to read as follows: <br /> 6. Conditional use permits are not required for land leveling activities or conservation prac- <br /> tices on agricultural land and where fill material or aggregate is removed from the property <br /> as an incidental activity. <br /> 31. Create a new iss 10.126 (2) (a) 7. to read as follows: <br /> 7. Portable cement batching or mixing plants or portable hot mix blacktop plants used in con- <br /> nection with a highway improvement or construction project do not require a, conditional use <br /> permit. Material produced by such a plant shall be used only for the project and sale or use <br /> of material dt any other location will require a conditional use permit. <br /> 31a. Create a new ss 10.126 (2) (a) 8. to read as follows: <br /> 8. Upon the expiration of any permit issued by the Zoning Administrator, the owner of a <br /> mineral extraction operation or his agent shall apply for a conditional use permit under <br /> Section 4. above. <br /> 32.
