SECTION 10.21; 10.2.2; 10,23; 10.24; 10.25
<br /> shall be discontinued for a period of one year, such non-conforming use will be deemed
<br /> to .haVe terminated and any future .use shall be in conformity to the provisions -of this
<br /> ordinance. No buildings or premises used as a non-conforming use shall be added to :or
<br /> structurally altered so as to increase the facilities for such non-conforming use...
<br /> (2)' Any building lawfully. erected prior to the adoption of this ordinance 'which does
<br /> not conform to the requirements of this ordinance as to setback,_ side yards ,,or .rear
<br /> yards, 'may be continued in use, but any future additions or structural alterations
<br /> shall conform to the provisions of this ordinance.
<br /> (3) Any existing non-conforming use may be changed to another non-conforming use of .
<br /> a similar or more restricted classification or to a conforming use; provided, however,
<br /> that when a use has been changed to. a conforming use of a more restricted non-conform-
<br /> ing use it may not again be changed to a less restricted use.
<br /> 10.22 INTERPRETATION AND APPLICATION
<br /> (1) In interpreting and applying the provisions of this ordinance they shall be held
<br /> to be minimum requirements for the promotion of health, safety, convenience, morals;,
<br /> comfort and general welfare. It is not intended by this ordinance. to interfere with
<br /> Or abrogate or annul any easements, covenants, or similar- agreements between parties;
<br /> nor is 'it 'intended by this ordinance to repeal, abrogate, annul or in any way impair .
<br /> or interfere with any existing provisions of law or ordinance, or any rules, regula
<br /> tions or permits previously issued .or adopted, or which may be issued or adopted
<br /> according to law, relating to the use, occupancy, location or height of buildings or
<br /> premises; provided, however, that when this Ordinance imposes a greater restriction,
<br /> upon the use, occupancy, location or height of buildings or premises than imposed by
<br /> such existing provisions of law or ordinance, or by such rules, regulations,- or ' •
<br /> permits, the provisions of this ordinance shall control.
<br /> 10..23 COMPLETION, 'RESTORATION OR 'ENLARGEMENT OF EXISTING STRUCTURES
<br /> (I) Nothing herein contained shall require any change in the plans, construction or
<br /> intended .use of a building or premises for' Which plans. have been prepared heretofore, -'
<br /> and the construction of which shall have been. diligently pursued within three (3)
<br /> months after the effective date of this ordinance. '
<br /> . (2) Nothing herein contained shall prevent .the alteration, restoration or,.. ,repair of '
<br /> any building occupied by anon-conforming use at the effective date of this ordinance;
<br /> provided, however, that the cost of such alteration, .restoration or repairs shall not
<br /> during the life of the building exceed fifty (50) per cent of the assessed valuation ,
<br /> Of such structure, or building, such valuation being that in effect for the year in
<br /> which- such use became non-conforming.
<br /> (3) Nothing herein contained shall prevent the restoration of a non-conforming'build-
<br /> ing or structure destroyed by fire, explosion, act-of God or act of public enemy,
<br /> provided, however; that if such destruction shall exceed' fifty (50) per cent. of' the
<br /> assessed valuation of such structure for the year in which such destruction occurs,
<br /> the future use, location, height, setback, rear and side .yards shall conform to this
<br /> ordinance.-
<br /> 10.24 CHANGES AND AMENDMENTS
<br /> (1) The Dane County -Board of Supervisors may from time to time alter, supplement or
<br /> change by .ordinance the boundaries or classification of districts designated in- this
<br /> ordinance, or any- of the provisions. or regulations imposed by this ordinance in the
<br /> manner provided bylaw.
<br /> 10.25 'ADMINISTRATION, ENFORCEMENT AND. PENALTIES
<br /> (1) ZONING SUPERVISOR
<br /> •
<br /> (a) The -provisions of this ordinance shall be administered by or under the direction
<br /> of the zoning supervisor', who in person or by duly authorized deputy or assistant.
<br /> shall have the right to enter upon premises affected by this ordinance at reasonable
<br /> ' hours for the purpose of inspection. The zoning supervisor 'shall hold his office
