DANE COUNTY ZONING ORDINANCE

<br /> BEING CHAPTER 10 OF THE ORDINANCES OF-DANE COUNTY
<br /> An ordinance to 'alter, supplement and change the boundaries and regulations contained
<br /> in that certain ordinance adopted by the Dane County Board of Supervisors on July 20,
<br /> 1938, as amended to and including October 25, 1949 which said ordinance is entitled
<br /> "A zoning ordinance enacted pursuant to the provisions of Sections 59.97 and 59.99 of
<br /> the. statutes and providing _penalties for the violation of its-provisions".
<br /> The Dane County Board of' Supervisors does ordain as follows:
<br /> Section 1. That certain ordinance adopted. by the County Board of Supervisors of Dane
<br /> County of July 20, 1938, as amended, the title to which is recited in the title to this
<br /> ordinance, shall hereafter be known and numbered as Chapter 10,. Dane County Ordinances;
<br /> and as so entitled and numbered said title is amended to read as follows:
<br /> An ordinance, to be'known .as Chapter 10, Dane County Ordinances, regulating, restricting
<br /> and determining the location of trades and industries, the location, height, bulk,
<br /> number of stories, and size of buildings and other structures, the percentage of lot
<br /> which may be occupied, the size. of yards and other open spaces, the density of. popu
<br /> lation, the location of buildings designed for specific uses; the areas along natural
<br /> water courses, streams and creeks in which trades and industries and the location of
<br /> buildings for specific uses may be prohibited; establishing setback lines;' and est-
<br /> ablishing districts Of such number, shape and area deemed best suited to carry out the
<br /> purposes of this ordinance as it appes to lands outside the limits of incorporated_
<br /> cities and villages in Dane County; and providing penalties, pursuant to the author-
<br /> ization of Section 59.97 and 59.99, Wisconsin' Statutes.
<br /> Section 2. Section 1 of the ordinance of July 20, 1938, the title to which is recited
<br /> in the title to this ordinance, is renumbered to be Section 10.01, Dane County Ordi
<br /> nances, 'as so renumbered is amended to read: •
<br /> 10.01 DEFINITIONS: For the purposes of this ordinance certain terms used herein are. de-
<br /> fined as follows: any words not defined herein shall be construed as defined in the
<br /> Wisconsin Building Code:
<br /> (1) Accessory Building: A subordinate or supplemental building, the use of which is in-
<br /> cidental to that of. the main building on the same lot:or the use of the premises on
<br /> which it .is located. .
<br /> (2) ' Accessory Use: A use customarily 'incident and accessory to the' principal. use..of a_ •
<br /> lot or parcel, or building or structure on the same lot or parcel as the principal use.
<br /> (3) Apartment House: A building containing accomodations for more than two families
<br /> living_ independently of each other.
<br /> (4) Apartment House Complex: A group. of apartment houses,, located on a single parcel of
<br /> land with certain facilities, such as ,driveways, parking spaces and the like, common to
<br /> the buildings in the complex. Apartment house complexes comprised of one hundred or
<br /> more units may include a restaurant, grocery store, drug store, personal service shop
<br /> and the like for the convenience of residents -in the complex.
<br /> (5) Bearings: For the purpose of property descriptions in this ordinance, when the -.
<br /> bearings north, South, East and west are used, they shall be construed as relative 'or
<br /> approximate,, and construed as following section lines, quarter section lines, quarter
<br /> quarter section lines, or lines parallel. to or at right. angles to such lines, or follow-
<br /> ing mapped property lines or highway' lines running approximately in the direction indi-
<br /> cated. Where exact bearings ,are, critical or significant to the description the 'exact
<br /> bearing will be used.
<br /> (6) Block: That property abutting on one side of .a street between the nearest inter-
<br /> secting street, railroad right of way-. or other natural barriers; providing, however,
<br /> that where a street curves so that any two chords thereof form an angle of one hundred
