fees waived for the construction of state and federal buildings where a permit is not required and would <br /> ordinarily not be issued. <br /> (c) Any permit issued pursuant to the provisions of this section shall expire one year from the date of <br /> issuance if construction has not started within that time. <br /> (4) FEES FOR PETITIONS TO AMEND THE ZONING ORDINANCE AND APPLICATIONS FOR CONDITIONAL,USE PERMITS <br /> (a) Petitions to amend the Zoning Ordinance and applications for conditional use permits $25.00 <br /> (b) Conditional use permits and renewals for mineral extraction as provided for in 10.12 (2)(a) 5. $10.00 <br /> (c) Erosion control permits $10.00 <br /> 1. Such fees shall be waived for any amendment to the text of the Dane County Zoning Ordinance when <br /> filed by any Dane County Supervisor or by any Town Board of Dane County or for an amendment to the Zoning <br /> Maps or application for a conditional use permit for land owned by any municipality when such a petition <br /> or application is filed by the governing body of that municipality. <br /> 2. Such fees shall be collected by the zoning supervisor at the time the application or petition•is <br /> filed, and shall be accounted for and paid into the general fund of the county as other moneys collected <br /> by the county. The zoning supervisor shall issue a receipt for each fee collected. <br /> (5) FEES FOR SPECIAL EXCEPTION PERMITS AND VARIANCES FROM THE ZONING ORDINANCE <br /> (a) Applications for special exception permits and variances from the Zoning Ordinance $15.00 <br /> 1. Such fees shall be waived if the land for which a special exception permit or a variance from the <br /> ordinance is sought is owned by any municipality and the application is made by the governing body of <br /> that municipality. <br /> 2. Such fees shall be collected by the zoning supervisor at the time the application is filed, and shall <br /> be accounted for and paid into the general fund of the county as other moneys collected by the county. <br /> The zoning supervisor shall issue a receipt for each fee collected. <br /> (6) ZONING COMMITTEE <br /> (a) The zoning committee shall be as created and constituted by the County Board and shall have the duties <br /> as prescribed by subsection (b) hereof. <br /> (b) It shall be the duty-of the zoning committee to supervise the administration of the zoning ordinance, <br /> to hold hearings on proposed amendments to this ordinance and to make recommendations thereon to the county <br /> board, to approve plats for record in accordance with the provisions of Section 236 (10)(b) of the statutes; <br /> and to perform such other duties in connection with zoning as may be delegated to it by the county board. <br /> (c) Effect of denial of a petition to change the zoning district boundaries: No petition for a change in <br /> the zoning district boundaries which has been denied by the Dane County Board of Supervisors shall be re- <br /> submitted for a period of one year from the date of said denial, except on the grounds of new evidence or <br /> proof of change of conditions found to be valid by the Zoning Committee. <br /> (7) CONDITIONAL USES <br /> (a) .Statement of Purpose: <br /> The development and execution of this ordinance is based upon the division of the County into districts, <br /> within which districts the use of land and buildings, and bulk and location of buildings and structures in <br /> relation to the land are mutually compatible, and substantially uniform. However, there are certain uses <br /> which, becuase of their unique characteristics, cannot be properly classified as unrestricted permitted <br /> uses in any particular district or districts, without consideration, in each case, of the impact of those <br /> uses upon neighboring land or public facilities, and of the public need for the particular use at a parti- <br /> cular location. Stich uses, nevertheless, may be necessary or desirable to be allowed in a particular <br /> district provided that duo consideration is given to location, development, and operation of such uses. <br /> Such uses are classified as conditional uses and are uses entirely private in character, but of such an <br /> unusual nature that their operation may give rise to unique problems with respect to their,impact upon <br /> neighboring property or public facilities. <br /> The following provisions are then established to regulate these conditional uses which require special con- <br /> sideration. <br /> (b) Authority: The Zoning Committee, after a public hearing, shall within a reasonable time, grant or deny <br /> any application for a conditional use. Prior to granting or denying a conditional use, the Committee shall <br /> make findings of fact based on evidence presented, that the standards herein prescribed will either be <br /> complied with or not be complied with. No permit shall be granted when the committee determines that the <br /> standards will not be met, nor shall a permit be denied when the Committee determines that the standards will <br /> be met. <br /> (c) Initiation of a conditional use: Any person, firm, corporation, or organization, having a freehold <br /> -24- <br />
