■ <br /> the occurrence of the regional flood. <br /> (4) MANUFACTURING AND INDUSTRIAL: Manufacturing and industrial buildings, structures <br /> and accessory uses shall be elevated or flood-proofed, in accordance with Section <br /> - 10.56 (e) to two feet above the regional flood elevation. Measures shall be taken <br /> to minimize interference with normal plant operations especially for streams having <br /> protracted flood durations. Certain accessory land uses such as yards and parking <br /> lots may be at lower elevations subject to requirements set out in Section 10.53 <br /> (d) (3) . <br /> (5) The storage or processing of materials that are buoyant, flamable, explosive, or <br /> which in times of flooding, could be injurious to human, animal, or plant life, shall <br /> be at or above the flood protection elevation for the particular area or flood proofed <br /> in compliance with Section 10.36 (e) of this Ordinance. <br /> (6) UTILITIES: Construction and substantial improvements to utilities may be permitted <br /> provided that they are flood proofed to the flood protection elevation pursuant to <br /> Section 10.56 (e) . <br /> (7) SEWAGE SYSTEMS: All on-site sewage disposal systems shall be flood proofed to the <br /> flood protection elevation pursuant to Section 10.36 (e) and shall meet the appli- <br /> cable provisions of local zoning ordinances and Wis. Admin. Code H 62.20. <br /> (8) WELLS: All wells, whether public or private, shall be flood proofed to the flood pro- <br /> tection elevation pursuant to Section 10.56 (e) and shall meet the applicable provi- <br /> sions of Chapters NR 111 and NR 112, Wis. Admin. Code. <br /> (9) SOLID WASTE DISPOSAL SITES: All solid waste disposal sites, whether Public or pri- <br /> vate, are prohibited in flood fringe areas. <br /> 10.54 GENERAL FLOOD PLAIN DISTRICT (GFP) <br /> (a) APPLICABILITY: The provisions for this district shall apply to all flood plains in <br /> Dane County for which "regional flood" data, as defined in the <br /> DEFINITIONS, Section 10.59 (a) (30) are not available or where regional flood data is <br /> available, but floodways have not been delineated. As adequate regional flood data <br /> becomes available and floodways are delineated for portions of this district, such por- <br /> tions shall be placed in the Regional Flood Fringe or Regional Floodway District, as <br /> appropriate. <br /> (b) DESCRIPTION OF DISTRICT: The general flood plain district shall include: <br /> (1) All A Zones shown on the Official Flood Plain Zoning Map which is based on Flood <br /> Insurance Study Maps and Flood Hazard Boundary Maps showing the rivers and their <br /> tributaries in Dane County, Wisconsin, prepared by Department of Housing and Urban <br /> Development dated September 29, 1978; and approved km the Department of Natural <br /> Resources. <br /> (c) PERMITTED USES: Those uses permitted in Section 10.52 (c) , (d) , 10.53 (c) and (d) , <br /> provided the procedures of Section 10.54 (d) below are met, and a zoning permit has been <br /> issued by the Zoning Administrator. <br /> (d) STANDARDS FOP DEVELOPMENT IN THE GENERAL FLOOD PLAIN DISTRICT: The general Flood Plain <br /> District encompasses both floodway and flood fringe areas. Therefore, a determination <br /> shall be made pursuant to Section 10.56 (e) , to determine whether the proposed use is lo- <br /> cated within a floodway or flood fringe area. If it is determined that a proposed use is <br /> located within a floodway, the provisions of Section 10.52 (c) , (d) of this Ordinance <br /> shall apply. If it is determined that the proposed use is located within the flood fringe, <br /> the provisions of Section 10.53 (c) , (d) shall apply. <br /> SECTION 10.55 NONCONFORMING USES <br /> (a) GENERAL: Insofar as the standards in this section are not inconsistent with the pro- <br /> visions of Section 59.97 (10) , Wis. Stats. , they shall apply to all nonconforming uses. <br /> The existing lawful use of a structure or building or its accessory use which is not in <br /> conformity with the provisions of this ordinance may be continued subject to the following <br /> conditions: <br /> (1) No modifications or additions to a non-conforming use shall be permitted unless they <br /> are made in conformity with the provisions of this section. For the purpose of this <br /> Section the words "modification" and "addition" shall include, but not be limited to, <br /> any alteration, addition, modification, re-building or replacement of any such exist- <br /> ing structure or accessory use. Ordinary maintenance repairs are not considered struc- <br /> tural repairs, modifications or additions; such ordinary maintenance repairs include <br /> internal and external painting, decorating, panelling, and the replacement of doors, <br /> windows, and other non-structural components; and <br /> 1 <br /> - 5 - <br />
