<br />Section 5. Sections III, N. V, VI, VII and VIII of the ordinance of
<br />July 20, 1938, the title of which is recited in the title to this ordinance, are
<br />hereby repealed.
<br />Section 6. Thirteen (13) new sections of the ordinance hereinabove
<br />numbered to be Chapter 10, Dane County Ordinances, are created, to be
<br />known and numbered as Sections 10.04 to 10.16, inclusive, to read as
<br />follows:
<br />10.04 RESTRICTIONS UPON LANDS, BUILDINGS AND STRUC-
<br />TURES.
<br />Except as otherwise herein provided:
<br />(1) Use. No building or structure shall hereafter be erected, and
<br />no existing building or structure shall be moved, altered, added to, or
<br />enlarged, nor shall any land, building, structure or premises be used,
<br />designed or intended to be used for any purpose, or in any manner other
<br />than a use designated in this ordinance as permitted in the district in
<br />which land, building or structure or premises is located.
<br />(2) Height. No building or structure shall be erected. nor shall any
<br />existing building or structure be moved, reconditioned, added to or struc-
<br />turally altered to exceed in height the limit established by this ordinance
<br />for the district in which such building or structure is located.
<br />(3) Percentage of Lot Occupancy. No building or structure shall
<br />hereafter be erected, nor shall any existing building be moved, altered,
<br />enlarged or rebuilt nor shall any open spaces surrounding any building
<br />or structure be encroached upon or reduced in any manner, nor shall a
<br />greater percentage conformity andthe aeand yard egulation es to the this
<br />ordinance, for the district in which such bulding is located.
<br />(4) Density of Populat;on. No building, structure or premises shall
<br />be erected, occupied or used so as to provide a greater density of popula-
<br />tion than is allowed by the terms of this ordinance for the district in which
<br />such building, structure or premises is located.
<br />(5) Open Space Limitations. No yard or other open space provided
<br />about any building or structure for the purpose of complying with the
<br />regulations of this ordinance shall be considered as providing yard or
<br />open space for anv other building or structure. No lot area shall be so
<br />reduced or diminished that yards or other open spaces shall be smaller
<br />than prescribed by this ordinance. i
<br />10.05 R -1 RESIDENCE DISTRICT.
<br />(1) Uses Permitted:
<br />(a) Single family detached dwellings.
<br />(b) Gardening, including truck gardens, nurseries and green houses,
<br />but not including the raising or keeping of poultry, livestock or fur bearing
<br />animals, including rabbits, except as otherwise herein provided. The keep-
<br />ing of horses and ponies, not to exceed four iw number, belonging to the
<br />owner or occupant of the premises, and not for hire, shall be permitted
<br />in this district.

<br />(c) Municipal buildings, except buildings for the repair or storage of
<br />road building or maintenance machinery.
<br />(d) Telephone telegraph and power transmission lines; water, gas and
<br />sewer lines: any building or structure accessory to the operation of such
<br />lines, including electric transformer stations, telephone exchanges, pumping
<br />l stations and the like.
<br />(e) Public parks; golf courses; tennis courts, archery range.
<br />(f) Churches and schools, colleges and universities conducted not for
<br />profit, but not including private music, dancing, business or vocational
<br />schools.
<br />(g) Institutions of a charitable or philanthropic nature; hospitals, clin-
<br />ics and sanatoria, except contagious hospitals and insane asylums.
<br />(h) Libraries, museums and community buildings; private clubs and
<br />JI fraternities, except those whose principal activity is a service customarily
<br />4: carried on as a business, and excepting also riding clubs.
<br />(` (i) Home occupations.
<br />j (j) Accessory buildings, including private garages and buildings clear -
<br />ly incidental to the residential use of the property; provided, however,
<br />that no accessory building may be used as a separate dwelling unit.
<br />(k) Signs and other advertising media as follows:
<br />1. To advertise a customary home occupation or professional office;
<br />provided that such sign shall be attached to the building and shall not
<br />j exceed two (2) square feet in gross area.
<br />2. To advertise the sale, rent, lease or trade of the property on which
<br />the sign is placed; provided that such sign shall not exceed six newly ((6) square
<br />feet sale or ubdivisons or sung tted slands nwhered the ddensity ofp con -
<br />struction does not exceed an average of one building for each two hundred
<br />(200) feet of frontage, such latter sign shall not exceed one hundred (100)
<br />square feet in gross area.
<br />3. To advertise that the site on which the sign
<br />ition of a future church, school, library, is located is the loca-
<br />' ry, club, or the like.
<br />4. Tablet inscription, emblem or bulletin board for churches, schools,
<br />a clubs, hospitals, religious or charitable institutions.
<br />0) Cemeteries, when they comply with the provisions of Section
<br />157.06 of the statutes.
<br />(2) Building Height Limit.
<br />(a) Buildings hereafter erected or structurally altered shall not exceed
<br />two and one -half (234) stories or thirty-five (35) feet in height.
<br />(3) Area, Frontage and Population Density Regulations.
<br />(a) The minimum lot or building site area shall be twenty thousand
<br />j (20.000) square feet and the minimum lot width shall be one hundred
<br />(100) feet. No building, together with its accessory buildings, shall occupy
<br />in excess of thirty (30) per cent of the area of an interior lot or thirty -five
<br />(35) per cent of the area of a corner lot.
<br />(4) Setback Requirements.
<br />(a) Setback from front lot line or highway right of way shall con-
<br />form to the requirements of Section 10.17.
<br />(5) Side Yard Requirements.
<br />(a) There shall be side yards in the aggregate of not less than thuty
<br />(30) feet and no single side yard shall be less than twelve and one -half
<br />(12%) feet in width.
<br />(6) Rear Yard Requirements.
<br />(a) The minimum depth of any rear yard shall be fifty (50) feet.
