The proposed highway to servo U.S. Highway -#12'franzits intersection <br />with U.S. Highways J12 curd =118 in Soo. 36, T7N, R9E, westward and <br />northward to its intorsection with U.S. Highvmy +12 in Sec. 2, <br />T7N, R8E. <br />The proposed relocation of State Trunk HiGlv^ay ti-113 from the south- <br />east corner of the villar-o linits of Waunakoo southeasterly to the <br />north linits of the City of 11adison. <br />(2) Class "B" highvays: All hi.hways in Dano County not otherwise rarkod <br />or classified, except streets loss than sixty- six*(66) foot wide plattod in <br />subdivisions recorded previous to the passa£;c of this ordinance, are hereby <br />designated as Class "B" highvmys. For all Class "B" hiClwmys, setback lines <br />located parallel to and distant scvonty -fivo (75) foot from the center lino of <br />the highway arc hereby established. <br />In no case shall tho setback linos in Class "11" or Class "B" highwyas be lo- <br />catod loss than forty -two (62) foot from the highway right of way line. <br />Where the location of two or more highvays of different classifications arc <br />coincidental, the greater setback shall apply. <br />SECTION X - NON- COA]FORMING USES: <br />The lawful use'of any building or proniises'oxistinG at the time of the adoption <br />of this ordinance, although such use does not conform to the provisions hereof, <br />nay be continued, but if such non- conforring use is discontnuod, any future use <br />of the said building or pronises shall be in confor.-Aty with the provisions of <br />this ordinance. <br />The non - conforming use of a building or pronises may be changod to another <br />non- conforninG use of tho same or a higher classification. Whenever a non - <br />confor= - C use of a buildinE or prondsos has been changed to a noro restricted <br />uso, such use shall not thereafter be changed to a loss restricted use. <br />Whenever district boundaries or regulations shall hereafter be changed, any <br />then oxisting non- confori:2ing use in such ci'aW:'Cd* diotrt ict•..r7ay .:be continued or <br />changed to a'uso permittod in the smae district as that in which the existing use <br />is pornittod, provided that all other rogulations goverinG the now use arc com- <br />plied with. <br />Irhmodiatoly after the passaGo and plublication of this ordinance, the County <br />Board of Supervisors shall cause to be nado a record of all non - conforming uses <br />in accordance with subsection seven (7)'of Soction 59.97 of the Wisconsin <br />statutes as artondod by the laws of 1935. <br />SECTION XI - CORIPLETION AND RESTORATION OF EXISTING BUILDINGS <br />NothinG herein contained shall require any chan.-o in the plans, construction <br />or intondcd use of a buildinG for which plans have boon proparod horotoforo and <br />the construction of tenich shall have boon diligently prosecuted within one (1) <br />north after the date of passagro of this ordinance, and the ground story frariowork <br />of which, includinC tho second tier of boars, shall havo boon comploted within <br />six (6) months after the date of passage of this ordinalaco., <br />Nothing; herein contained shall prove-Tit the restoration of a building dostt.yed <br />by fire, explosion, act of God or act of the public onony subsequent to the <br />passaGo of this ordinance; except that a non - conforming use so destroyed, to the <br />extent of fifty (50 %) percont.or norc of its assessed valuation; according to the <br />assessment for the fiscal yoar in avhich such destruction occurs, shall, fron and <br />after the date of such destruction, conform to all of the rcgulations of the <br />district in which it is located. <br />SECTION XII -. BOU11]DARIES OF DISTRICTS <br />In unsubdivic ?ed property, unless otherwise indicated on the reap, the district <br />boundary lines are the center lines of streets,' highways, railroads, section lines <br />or quarter section lines or such linos extended. Whore district boundary lines <br />are indicated as adjacent and parallel or approxivatcly parallel to street, high- <br />way or railroad lines, such distract boundary lines shall be assumed to be not <br />loss than three hundred (300) feet from the nearest right -of -way line ricasured <br />at right angles to such right- of -vmy line. <br />Where uncort'ainty exists with respect to the bouundaries of the various districts <br />shown on the reap .acwi�. .yinG and r.=ado a part of this ordinance, such bouundaries <br />shall be detorminod by the uso of tho scale contained on such nap. <br />-6- <br />
