SECTION XIII INTERPRETATION A11D J DPLIC .TION <br />r <br />In interpreting and applying tre provisions of ,'this -ordi- na2i:ce.,- they -shall be <br />held to be .the minimum requirements for the promotion of public health, safety. <br />and .general welfare. <br />It is not ' intended...: y. ,this'.ord n6Lnce.,.to,.lntarf ©re`.:tfi3 th,: sU�ggate :os �&nnu]:..ansr? <br />existing easements, covenant--s; or other agreerL�nts between parties, nor is it <br />intended by. this ordinance to`. repoal, abrogate, annul- or in any way to impair or <br />interfere with any existing provisions of law br ordinance or'any rules, regula- <br />tions or permits previously adopted, or issued, or which shall be adopted or <br />issued pursuant to.law, relating to.the use of buildings or premises; provided, <br />however, that where this ordina.nco imposes a greater restriction upon the use <br />of buildings'or premises than is imposed or required by such existing provision <br />of law or ordinance or by such rules, regulations, agreements, covenants,•or <br />permits, the provisions of-this ordinance shall control. <br />Nothing herein contained shall be construed to prohibit the permitted use of <br />premises or the oroction or alteration of buildings for uses permitted'in the <br />various districts'on a'single lot or .tract of land 'of less area than is required <br />by the district regulations for'the district in which such premises or 'building <br />is located;, Provided, that such single lot or tract of lLnd was recorded as such <br />,previous .to, the passage of this ''ordinance. <br />SECTION _XIV `BOARD OF ADJUSTDUPNT <br />There shall be a board of adjustment coiisistiAg of three (3) members to be <br />appointed by the chairman of the county board with the - approval of the county board <br />and in accordance with subsection'tup (2) of section 59.99 of the Wisconsin,Statutos <br />as amended by'the laws of 1935. <br />Powers and Duties <br />1. The board shall moot "at the call of the'chairmaan, and at such othor times as <br />the board'may determine, at a fixed time and place. <br />l <br />2. All meetings of the board shall-bo opon,.to the public. <br />3.. -Tho board shall keep minutes of its proceedings . showing vote of Icach 'momber -" <br />upon each question, or, if absent or failing to vote, indicating such fact,.and <br />shall keep records 'of its examinations and other official actions, all of which <br />shall be immediately filod in the office of the board and shall be'a publie'record., <br />4. Tho board shall have power to call on any other county departments for assis- <br />tance in the performanco of its'duties.and it shall be the duty of such other <br />departments to render all such assistance as may be reasonably required. <br />5. The board may adopt such rules as aro- necessary to carry into. effect the- <br />regulations of the . county board.. <br />6. In the case of all appeals, the board of adjustment shall call upon the county <br />park commissions Per all information pertinent to the decision appealed from. <br />Appeals to the board of .adjustments may be takon-by any person aggrieved or <br />by any officer, dopartmont, board or bureau'of Dane County affected by any decision <br />of the administrative officer. Such appeals shall be taken within a reasonable <br />time, as provided by the rules of the board of adjustmont, by filing with the <br />of from whom the appeal is. takon and with the board of adjustment a notice <br />- <br />of appeal specifying the grounds thereof'. The officer from whom the appeal'is <br />taken shall forth -Tith transmit, to the board of adjustment all the papers'con.sti- <br />tuting the record 1upon vahich the action appealed from was taken. <br />An appeal -shall stay all proceedings in' furthorance of Lthe' action appealed from, <br />unless the officer from whom the appeal is taken shall .certify to the board of <br />adjustment after -the notice `of appeal ,shall havo" been filed with him by, reason of <br />facts stated in the certificate a stay would cause imminent peril to life or <br />property. In-such case, the proceedings shall not be stayed oche vise: than, by a <br />restraining order, which maybe granted by the board of adjustment or by a court <br />of record on application or notice to the officer from whom the appeal is taken <br />and on due dauso, shown. <br />Tho " board of adjustment shall f ix a reasonable timo ' fo r the hearing of the <br />appeal, give public notice-thoroof, as well as due notice to the parties in interest, <br />and decide the same within a roasonabl'e.tire. Upon the hearing, any party may <br />appear in person or by agent or by.attoraoy. <br />-7" <br />
