The proposed highway -to -sorvo LT, S, Highway #12-frun-its intorsoction <br />with U.S. Highways #12 an-0.? 18 in Soo. 36, M, R9E, wostward and <br />northward to its intorsoction with U.S. Hi3hvray +12 in Sec. 2, <br />Mi , RBE. <br />The proposed relocation of Stato Trunk Highway 7-;'113 from the south- <br />east corner of the villao limits of Waunakeo southeasterly to the <br />north limits of the City of Madison. <br />(2) Class "B" highways: All hiChti-rays in Danc County not otherwise marked <br />or classified, except streets less than sixty -six (66) feet widb platted in <br />subdivisions'rocorded previous to the passaCo of this -ordinanoo, are hcreby <br />dosignatod as Class "B" highways. For all Class "B" highways, setback lines <br />located parallel to and distant seventy -five (75) foot from tho cantor line of <br />the highway are hcreby establishod. <br />In no case shall the setback lines in Class "All or Class "B" hiGhwyas bo'.lo -- <br />catod loss than forty -two (42) foot iron the highway right of way line. <br />Where -the location of two or raoro highways of different classifications are <br />coincidental, the greater setback shall apply. <br />SECTION X NON -CONFO + NG- USES : <br />The lawful use' of any building or prordsos existing at the time of the adopt-ion- <br />of this ordinance,'although such use roes not conform to the provisions hereof, <br />nay be continued, but if such non- con_'"orr uiC use is discontnucd, any futuro use <br />of the said building or ;:remises shall be in conforrdty with the provisions of , <br />this ordinance. <br />The non - conforming use of a building or premise 's my' be changed to another <br />non - conforming uso- of the same or a higher classification. Whenever a non - <br />conforninG use of a building or promises has boon changed to a more restricted <br />use, such use shall not thereafter be changed to a less restricted use. <br />Whenever district boundaries or regulations shall hereafter be changed, any <br />then existing non- confor inS use in such :be• continued or <br />changed to a" use perrdttod in the same district as that in which tho existing use <br />is permitted -, provided that all other regulations goverino the new use aro con- - <br />plied with. <br />Immediately after the passago and plublication of this ordinance, the County <br />Board of Supervisors shall cause to be made a record of all non- conforning uses <br />in accordance with subsection seven (7)'of Soction 59.97 of the Wisconsin <br />statutes as ariondod by the laws of'1935. <br />SECTION XI.- COIPLETION AND RESTORATION OF EXISTING BUILDINGS <br />Nothing; herein contained shall require any chando in tho plans, construction <br />or intended use of a building for which plans have boor_ prepared heretofore and <br />the construction of which shall have boon diligently prosecuted within one.(1) <br />month after the elate of passaGo of this ordinance, and the ground story franowork <br />of which, including the second tier of boats, shall. havo been coLipleted within <br />six (6) months after the date of passage of this ordinance. <br />Nothing herein contained`shall prevent. the restoration of a building destroyed <br />by fire,-explosion, act of God or act-of the public oneny subsequent to the <br />passage of this ordinance; except that a non - conforming use so destroyed, to the <br />extent of fifty (50 %) percent or more of its assessed valuation; according to the <br />assessment for the fiscal year in which such destruction occurs, shall, from and <br />after the date of such destruction, conform to all of the regulations of the <br />district in which it is located. <br />SECTION XII - .BOUNDARIES OF DISTRICTS <br />In unsubdivicled property, uinloss' otherwise indicated bn the rap, the district <br />boundary lines are'tho center lines of stroets, highways, railroads, section lines <br />or quarter section lines or such lines extended. More district boundary lines <br />are indicated as adjacent and parallel or approxinatoly parallel to street, high- <br />way -or railroad lines, such district boundary lines shall be assured to be not <br />less than threo. hundred (300) feet from the nearest right -of -way line mciasured <br />at right angles to such right -of -way, line. <br />Where uncertainty exists with respect to the boun daries of the various districts <br />shown. on the Lap. ng , and nado a part of this. ordinance, such boundaries <br />shall be detorrdnod by the use of the scalo contained on such map. <br />
