General Provisions and Exceptions

<br />Section 10. 16
<br />(a) Except as otherwise expressly provided, any use listed as a permitted. use in any
<br />district shall be construed as a prohibited use in a more restricted district.
<br />(b) The following uses shall be permitted in the districts specified when such uses
<br />do not alter the character of the premises in respect to their use for the purposes
<br />permitted in:such district.
<br />1. In any district, real estate offices and signs advertising property for sale,
<br />for a period not to exceed one (1) year.
<br />2. In any district., temporary buildings and the temporary storage of materials and
<br />equipment incident to the construction of buildings on the premises, for a period not
<br />to exceed one year.
<br />3. In the RH-1 and the R--1 Districts-separate accessory buildings may be used for
<br />the housing of servants or the accomodat�ion of guests of the owner or occupant.
<br />4. In.any district, where lands are used for-farm and garden purposes, separate
<br />accessory. buildings may be used for the regular or temporary housing of farm labor, or
<br />a separate dwelling may be provided for the family of a farm manager or laborer.
<br />5. In any district, while residential construction is in progress, the owner or
<br />builder may occupy.a house.trailer on the premises for a period not to exceed six (6)
<br />months prior to- commencement of such construction and for such period thereafter as
<br />may be reasonably necessary for completion thereof.
<br />(2) Height.
<br />(a) Hospiitals, churches, schools, radio transmission towers, water towers, chimneys,
<br />spires, pent houses, cupolos, silos, windmills and similar structures may be erected
<br />to a height greater than the maximum permitted in the district in which they are lo-
<br />cated, provided, however, that not part of such structure above the height limit shall
<br />be used for residential purposes.
<br />(3) Area, Frontage and Population Density.
<br />j, (a) Any lot or parcel shown on a recorded subdivision,- plat or assessor s plat, or
<br />conveyance recorded in the office of the register of deeds for Dane County.prior to
<br />the adoption of this. ordinance, may be used as a building site, or for any purpose
<br />permitted by this ordinance, even though such lot or parcel does not conform to the
<br />minimum frontage or area requirements of the district in which it is located pro-
<br />vided, however, that no multiple family dwelling,, or residential unit in combination
<br />with some other use, shall be erected, structurally altered or converted in use on
<br />lots having a width -of less than fifty (50) feet.
<br />(b) Any lot or parcel shown on a recorded subdivision, plat, or assessor's plat, or
<br />conveyance and recorded in the office of the register of deeds for Dane County prior to
<br />the adoption of this ordinance, may be increased in size by the addition of all or
<br />part of the adjoining lots or parcels and such resulting lots or parcels may be used
<br />for any purpose permitted in the district in which it is located even though by such
<br />addition such lots or parcels do not reach the minimum area or frontage required in
<br />such district; provided, however, that subsequent to such addition, the side yard,
<br />open space and p:Qcentage of occupancy provisions for lots of the resulting size shall
<br />apply; and provided further, that after buildings have been erected on such lots or
<br />parcels.their area or width shall not thereafter be reduced, except in conformity to
<br />the provisions of this ordinance.
<br />(4) Setback.
<br />(a) The setback of buildings for uses designated in Section .10. 05 (1)(f),.(g) and
<br />(h) shall be not I.exs than fifty (50) feet; and for uses designated in Section 10.
<br />12 (1)(g) the minimum setback shall be seventy--five (75) feet.
<br />(b) In no district shall any part of the building p roject.into any setback area
<br />except chimneys, steps,, opn porches not covered or enclosed and not more than two (2)
<br />feet above grade.
