Completition9 Restoration or Enlargement <br />of- Existing Structures <br />(3).Any existing non-conforming use may be changed to another non-conforming use <br />of a similar or more restricted classification or to a conforming use; provided, how- <br />ever, that when a use has been chianged to -a conforming use or a more restricted non <br />conforming use it may not again be changed to a less restricted.use. <br />10. 22. INTERPRETATION AND .APPLICATION <br />(1) In interpreting and applying the provisions of this ordinance they shall be <br />held to be minimum requirements for the promotion of health, safety,convenience, <br />morals, comfort and general welfare. It is -not intended by this ordinance to inter- <br />fere with or abrogate or annul any easements, covenants, or similar agreements between <br />parties, nor is it intended by this ordinance to repeal, abrogate, annul or in any way <br />impair or interfere with . any. existing provisions of law or ordinance, or any rules, <br />regulations or permits.previously issued or adopted, or which shall be issued or <br />adopted according to law, .relating to the use, occupancy, location or height of <br />buildings or premises; provided, however, that when this ordinance imposes a greater <br />restriction upon the use, occupancy, location or height of buildings or premises than <br />is. imposed by such existing provisions of law or ordinance, or by such rules, regula- <br />tions, or permits, the provisions of this ordinance shall control. <br />10.23 COMPLETION, RESTORATION OR ENLARGEMENT OF EXISTING STRUCTURES <br />i(1) Nothing herein contained shall require any change in the pl ansm construction, <br />or intended use of a building or premises for which plans have been prepared hereto- <br />fore, and the construction of which shall have been diligently pursued within three <br />(3) months after the effective date.of this ordinance. <br />(2) Nothing herein contained shall prevent the structural alteration, restoration, <br />or repair of any structure or building occupied by a ndndonforming - use at the.- <br />effec-tive date of this ordinance, provided, however, that the cost of such alteration, re- <br />storation or repairs shall not during the life of such building exceed fifty (50) per <br />cent of the assessed valuation of such structure or building, said.valua;tion being <br />that in effect for-the year in which such use became non - conforming. <br />(3) Nothing herein. contained shall prevent the restoration of a non - conforming <br />building or structure destroyed by fire, explosion, act of God or act of public.enemy; <br />provided, however, that if such destruction shall exceed fifty (50) per cent of the <br />assessed valuation of swh structure for the year in which such destruction occurs, <br />the•future: use., location, height, setback, rear and side yards shall conform to this <br />ordinance. <br />10.24 CHANGES-AND AMENDMENTS <br />(1) The Dane County Board of Supervisors may from time to.time alter, supplement or <br />change-by ordinance the boundaries or classification of districts designated in this <br />ordinance, or any of the provisions or regulations imposed by this ordinance in the <br />manner provided by law.
