VOL. 471 PAGE368 <br />assigns FOREVER.; <br />And• the_ said John C. McKenna, Jr. and Marian G. <br />McKenna, his wife, for themselves, their heir's, executors and <br />administrators, do covenant and agree with the said parties <br />of the second part, their heirs and assigns, that at the time <br />of the ensealing and delivery of these presents they are well <br />seized of the premises above described, as of a good, perfect, <br />and absolute estate in fee simple, free and clear of all en- <br />cumbrances whatever, said parties of the second part to pay all <br />taxes and special assessments levied for the year 1946 and <br />subsequent years; and the parties of the first part do further <br />covenant and agree that they will forever warrant and defend <br />the above bargained premises in the quiet and peaceable posses- <br />sion of the parties of the second part, their heirs and assigns, <br />against all and every person or persons lawfully claiming the <br />whole or any part thereof. <br />IT IS UNDERSTOOD AND AGREED between the parties hereto <br />that the land hereby conveyed shall be subject to the following <br />RESTRICTIONS: <br />1. The land heretofore described shall be used <br />strictly for residential purposes. Any parcel with a road <br />frontage of less than 100 feet or a ground area of less than <br />32,000 square feet shall not have any building structure <br />erected thereon. Any portion of said description having a <br />road frontage of not less than 100 feet and an area of S2,000 <br />square feet shall have constructed thereon not more nor other <br />than: <br />(a) One • single- foamily dwelling not exceeding two <br />and one—half stories in heightho <br />(b) One private one —car or two -scar garage not ex- <br />ceeding 500 square feet in area. <br />(c) Two outbuildings, provided. ' that the aggregate <br />ground area of such buildings shall not exceed <br />two hundred (200). square feet in area. <br />2e No structure shall be occupied for dwelling quarters <br />unless sanitary facilities are provided in the structure. <br />3. No part of any building, except the cornice or <br />eaves, shall be located closer than 40 feet to, nor farther than <br />SO feet from, the street or highway line nor closer than 20 feet <br />to the side property line., <br />
