No noxious or offensive trade or activity shall be <br />carried on, nor shall anything be done which may be or become <br />a nuisance to the neighborhood. This shall not be construed <br />to prevent gardens and orchards, and 25 laying hens for each <br />32,000 square feet of ground area. <br />7. Only members of the Caucasian race shall use or <br />occupy any dwelling constructed thereon except this restriction <br />shall not prevent occupancy by domestic servants of a different <br />race employed by an owner or tenant. <br />8. No trailer, basement, tent, shack, garage, barn <br />or outbuilding, or any part thereof, erected on this description <br />shall at any time be used as a residence, temporarily or <br />permanently, nor shall any residence of a temporary character <br />be used as a dwelling. <br />9. No building previously erected elsewhere shall <br />be moved upon any part of this description, except new pre- <br />fabricated construction. <br />10. No building shall be placed or erected on the premises <br />hereby conveyed until the plans, specifications and plot show- <br />ing the location of such building have.been approved in writing <br />by said John C. McKenna, Jr., or his agent appointed in writing <br />for said purpose. John C. McKenna, Jr. shall assign his rights <br />to approve such plans, specifications, and plot plans to a <br />committee of three persons elected from and by the fee holders <br />subject to these restrictions after John C. McKenna, Jr. has <br />conveyed ten parcels in the: <br />Northeast quarter of Section Thirty --one, <br />Town Seven North, Range Dine East, <br />subject to these restrictions. In the event such committee is <br />not in existence, or fails to approve or disapprove such plans, <br />specifications and plot plans within ten days after the same have <br />been submitted to any two members of said committee, then such <br />approval shall not be required, providing that the design <br />conforms to and is in harmony with existing struetureson <br />the parcels of land in the: <br />Northeast quarter of Section Thirty —one, <br />Town Seven North, Range 9 East, <br />subject to these restrictions. In any case, either with or <br />without approval as herein before required, no single - -story <br />dwelling structure of less than 800 square feet first floor <br />area nor any two - -story dwelling structure of less than <br />1200 total square feet of first and second floor area shall be <br />permitted; floor area requirements to be computed as includ- <br />ing stair openings, but excluding attached garages and <br />porches. Detached garage and outbuildings are to be so <br />designed, finished and roofed as to harmonize with the dwell- <br />ing structure to which they pertain. <br />
