DANE COUNTY ORDINANCE AMENDMENT NO. 7880 <br />Amending Section 10.03 relating to Zoning Districts in the Town of Burke. <br />The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br />Maps of the Town of Burke be amended to include in the C-2 Commercial District/s the <br />following described land: <br />PETITION NUMBER: 7880 <br />Part of the SE 114 of Section 14, Town of Burke described as follows: Commencing at <br />the South quarter comer; thence N00°41'39" East 1260.39 feet along the North-South <br />quarter line to the point of beginning; thence N39°09'50" East 506.33 feet along the <br />Southeasterly right-of-way of US Highway 151, thence East 2324 along the North line of <br />the S 114 N 112 SE 1/4; thence South 990 feet along the East line of the SE 114 and the <br />centerline of Reiner Road. Thence West 2640 feet along the South line of the N 112 S 1/2 <br />of SE 114; thence N00°41'39" East 518 feet along the North-South quarter line to the <br />point of beginning. <br />CONDITIONAL ZONING <br />Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b) of the Dane <br />County Code of Ordinances. The rezoned area shall be subject to the following conditions. <br />DEED RESTRICTION REQUIRED <br />This amendment will be effective, if within 90 days of its adoption by Dane County the owner or owners of <br />the land shall record the following restrictions on said land: <br />1. That the following permitted uses in the C-2 Commercial District are prohibited: (d) sales of new and <br />used mobile homes, recreational equipment rental, sales, and service; (h) bulk fuel storage, sales, and <br />storage of lumber and building material; (i) truck and bus terminals; (k) fertilizer mixing or blending <br />plants; (1) slaughterhouses, meat processing plants; (q) parking or storing of motor vehicles; and (r) storage <br />or processing of scrap or waste materials, conducted entirely within a building and that the buildings are <br />limited to a single level. <br />Said restrictions shall nn in favor of Dane County and the pertinentTown Board as well as the owners of land <br />within 300 feet of the site. Failure to record the restrictionswill cause the rezone to be null and void. <br />A copy of the recorded document shall be submitted to Dane County Zoning. <br />K 16'f <br />tO <br />t`E <br />The Dane County Board of Supervisors does ordain that this amendment, based upon their fmdings, to be <br />consistent with the provisions of Wisconsin State Statute 91.77 (1)(a),(b),(c). <br />
