Please see the attached map. The registration occurred in 1969, <br />and all such mineral extraction sites were subsequently deemed nonconforming (a/k/a "grandfathered") uses. <br />The Dane County Board of Supervisors is considering a change to the zoning ordinance that will affect <br />dormant or abandoned nonconforming mineral extraction sites like yours. The change will require any new <br />extraction operations to obtain a conditional use permit whether or not it was registered in 1969. This does <br />not affect current active sites which have reclamation plans on file with Dane County. <br />Ordinance Amendment #26, 2013-14, would remove language concerning inactive sites in section 10.21(1)(d) <br />of the code.The language that will be deleted is as follows: <br />(d) Mineral extraction sites that were registered as nonconforming sites as provided by this ordinance <br />shall not be considered abandoned ordiscontinued if the site is inactive for more than one year. <br />Your property is one of approximately 40 such dormant or abandoned registered mineral extraction sites in <br />Dane County. It appears the site is either depleted, dormant, abandoned or reclaimed. The site does not <br />have a reclamation permit or plan, nor is it a part of the required annual extraction site registration. <br />If the ordinanoe is adopted, any future mineral extraction activity on your property will need to obtain a <br />Conditional Use Permit prior to commencing operations.
