Questions & Answers Regarding Nonconforming Mineral Extraction Operations <br />Q: What is currently required to begin mineral extraction operations on my property? <br />In order for your nonconforming mineral extraction site to become an active operation, a reclamation plan and <br />permit must be submitted and approved by Dane County Zoning in conjunction with the Land and Water <br />Resources Department. In addition, the site must have financial assurance on file with the county that would <br />cover the cost of reclamation responsibilities in case an owner or operator fails to reclaim the mineral <br />extraction site. The amount of financial assurance is $1500 / acre. In addition, a yearly annual report must <br />be submitted to the county that discloses reclaimed and active acreages. Further information can be found in <br />Ch. 74 of the county ordinances. htti):Hdanedocs.countvofdane.com/webdocs/pdf/ordinances/ord074.pdf <br />If ordinance amendment #26 is adopted, a Conditional Use Permit approved by the town and county would <br />also be required. <br />Q: How can mineral resources my property be protected for use in the future? <br />The county's nonmetallic mining ordinance establishes a process whereby property owners may register their <br />marketable non-metallic mineral deposits with the town and county. The registration may be done without <br />first obtaining a conditional use' permit.
