a AGREEMENT FOR ORDERLY DEVELOPMENT BETWEEN THE VILLAGE OF DEFOREST AND TOWN OF VIENNA This Agreement entered into by and between the Village of DeForest, a municipal corporation, Dane County, Wisconsin, hereinafter referred to as "Village," and the Town of Vienna, a municipal corporation, Dane County, Wisconsin, hereinafter referred to as -"Town," and Town of Vienna Utility District #1, a municipal corporation, Dane County, Wisconsin, hereinafter referred to as "Town Utility District." WHEREAS, on March 21, 1988, the Village adopted Ordinance No. 88-8 purportedly annexing a portion of land from the Town; and WHEREAS, the Town has initiated a lawsuit, more specifically known as Case No. 88-CV-2924, in Dane County Circuit Court challenging the Village's annexation and making claims for damages; and WHEREAS, it is the desire of the parties hereto to agree upon the boundaries of lands to be annexed from the Town to the Village and certain future annexations of territory from the Town; and WHEREAS, it is further the desire of the parties to agree to the orderly development of lands lying within the Town, Town Utility District and the Village; and WHEREAS, it is further the desire of the parties to resolve their present water and sewer use disputes, including the setting of boundaries for service, and the settlement and compromise of the issues in the litigation. NOW, THEREFORE, in consideration of the mutual covenants and promises contained herein, the parties hereto mutually stipulate and agree as follows: I. PURPOSE The purpose of this Agreement is to resolve issues between the parties concerning the future growth and development of the Village, the Town and Town Utility District.
