• <br />attached hereto and made a part hereof. Upon <br />annexation, the land within the Green Zone <br />currently within the Town shall be part of the <br />boundaries of the Village. <br />3. THE YELLOW ZONE DESCRIBING THE JOINT <br />INDUSTRIAL/COMMERCIAL DEVELOPMENTAL ZONE - The <br />Yellow Zone consists of land lying within the Town <br />and Village. The land within the Yellow Zone is <br />subject to the jurisdiction of the Joint <br />Development Board as provided in Article VI <br />hereof. This land is considered prime developable <br />land which can be best developed to its highest <br />and best use through recommendations of the Joint <br />Development Board. The legal description of the <br />boundaries of the Yellow Zone is set forth in the <br />Exhibit 3 ("Yellow") attached hereto and made a <br />part hereof. <br />III. MUNICIPAL BOUNDARIES <br />Pursuant to the provisions of Section 66.027, Wis. Stats. <br />(1987-88), the common boundary line between the Town and the <br />village shall be as set forth in Exhibit 4 attached hereto and <br />made a part hereof. <br />The legal description of the land, formerly in the Town of <br />Vienna, to be included within the corporate boundaries of the <br />Village of DeForest is contained in Exhibit 5 attached hereto and <br />made a part hereof. <br />The parties request that the Circuit Court of Dane County, <br />Wisconsin, in Case No. 88-CV-2924, the Honorable Gerald C. Nichol <br />presiding, enter a final judgment incorporating the provisions of <br />this Agreement, fixing and establishing the common boundary line <br />between the Town of Vienna and the Village of DeForest. <br />IV. VILLAGE WATER SERVICE <br />A. The Village agrees to provide to and the Town hereby <br />agrees to accept from the Village extension of Village <br />water services to any area within the Yellow Zone upon <br />the Town's written request to the Village. The Village <br />warrants and represents that its present water system <br />has the capacity to fully service the Yellow Zone. The <br />Village further warrants and represents that it shall <br />reserve capacity of its present water system to fully <br />service the Yellow Zone.
