solely paid for and shall be the responsibility of the <br />Village. The Town shall be responsible and pay for the <br />water service from the Town's boundary to the owner of <br />the particular parcel of land within the Town receiving <br />the water services. The Village and Town may choose to <br />recover their costs by special assessment against the <br />land within their respective boundaries. <br />B. Any request for Village water service to be provided in <br />the Town shall be initiated through Town Board action, <br />reduced to writing and submitted to the Village Clerk <br />by the Town Clerk. Upon the Village Clerk receiving <br />such a request, the Clerk shall forward the request to <br />the Village Water Utility, Village engineer and to the <br />Town's engineer who shall mutually investigate the <br />request and jointly prepare a report setting forth the <br />manner, and any costs thereof, by which the water <br />services shall be provided. The joint report shall be <br />forwarded to the Clerks of the Village and Town. If <br />the Village and the Town cannot agree on the best <br />method and the costs thereof, for providing the water <br />services, the final decision on the method and any <br />costs thereof shall be made in accordance with the <br />terms of this Agreement and by arbitration as provided <br />for in Article VIII of this Agreement. <br />C. All rates, charges, assessments or other costs for <br />water services shall be fair and equitable, and the <br />costs shall be charged to Town property owners on the <br />same basis and in the same manner as such similar costs <br />are charged by the Village to property owners of the <br />Village. The Town shall have the right of discovery as <br />set forth in the Wisconsin Statutes on Civil Procedure <br />as to any and all methods and/or costs for providing <br />such water service. The parties agree that the Public <br />Service Commission shall have final determination of <br />all rates and assessments for water services. <br />D. Terms and conditions of water service: <br />1. The Town shall not permit any water furnished <br />hereunder to be used to supply any party outside <br />of the Yellow Zone without prior written approval <br />of the Village. This provision shall not apply to <br />service needed in the case of an emergency. <br />2.
