MAY 21 SESSION, 1970 41 <br />CHAPTER 28 <br />DANE COUNTY ORDINANCES <br />LAND DIVISION AND SUBDIVISION REGULATIONS <br />SECTION 28.10 <br />INTRODUCTION <br />28.11 Authority <br />These regulations are adopted under the authority granted by <br />Section 236.45 of the Wisconsin. Statutes, and pursuant to <br />59.97(3), 144.26(2) and 144.26(8) of the Wisconsin Statutes. <br />28.12 Purpose and Intent <br />The purpose of this ordinance is to promote the public health, <br />safety and general welfare of the County, and is designed to <br />lessen congestion in the streets and highways; to further the <br />orderly layout and use of land; to secure safety from fire, panic <br />and other dangers; to provide adequate light and air; to prevent <br />the overcrowding of land; to avoid undue concentration of <br />population; to facilitate the adequate provision for transporta- <br />tion, water, sewerage, surface drainage, schools, parks, play- <br />grounds and other public requirements; to facilitate the further <br />resubdivision of larger parcels into smaller parcels of land. <br />28.13 Severability <br />If any section, provision or portion of this ordinance is adjudged <br />invalid by a court of competent jurisdiction, the remainder of <br />this ordinance shall not be affected thereby. <br />28.14 Repeal <br />All other ordinances or parts of ordinances of Dane County in- <br />consistent or in conflict with this ordinance, to the extent of <br />inconsistency or conflict only, are hereby repealed. <br />28.15 Title <br />This ordinance shall be known as the "LAND DIVISION AND <br />SUBDIVISION REGULATIONS. DANE COUNTY, WISCON- <br />SIN." <br />28.16 Effective Date <br />This ordinance shall be effective after a public hearing, adop- <br />tion by the County Board of Supervisors and publication. <br />28.17 Definitions <br />For the purpose of these regulations certain words or phrases <br />used herein are defined as follows: <br />(1) Agency <br />The Dane County Zoning, Planning, and Water Resources <br />Committee. <br />(2) Certified Survey Map <br />A map of a land division, not a subdivision, prepared in <br />accordance with Section 236.34, Wisconsin Statutes. <br />(3) Development Plan <br />A total site plan of an area of land 80 acres or more in size <br />all under control of a subdivider(s) at the time of sub- <br />mission for review. Said plan shall specify and clearly <br />illustrate the location, relationship, and nature of all <br />primary and secondary uses, public and private easements, <br />public and private streets, pedestrian paths and common <br />open spaces. <br />
