Dane County Planning & Development
Division of Zoning
April 25, 2007 VIA Electronic Mail and U.S. Postal Service
Cymbre Van Fossen
Assistant Vice President
First Business Trust & Investments
401 Charmany Drive
Madison, WI 53719
CrOLJED)''
RE: 8605 Schoepp Road, Section 03, Town of Roxbury
PINs: 0907-032-8020-0, 0907-032-8000-4, 0807-031-8610-7 and 0907-032-8610-7
Dear Ms. Van Fossen:
Thank you for your letter of March 6, 2007 and the attached materials supporting your Request for
Determination regarding the property described above. As we discussed when you phoned today, this matter
has been pending since April of 2006, when you addressed your request to the Dane County Zoning
Administrator. I apologize sincerely for the very lengthy delay. Although I cannot account for the lack of a
response from the former Zoning Administrator, I take full responsibility for failing to answer your most
recent letter in a more timely manner.
Your application dated 04/06/2006 requested official determinations of Wetlands status, Floodplain status and
Ordinary high Water Mark location for the four parcels listed above. It is apparent that I was not able to
review this request in detail earlier. Much of the information you seek may be determined by a Registered
Land Surveyor, specifically:
1) The Ordinary High Water Mark (OHWM) for Fish Lake is located at an elevation of 858.70 feet above
Mean Sea Level, as set by the Wisconsin Department of Natural Resources (WDNR) on 06/22/1998. The
Zoning Administrator's determination is necessary only when no official OHWM elevation is available.
The OHWM is shown by the blue line on the enclosed aerial photo map.
2) The Base FIood Elevation or boundary of the Special Flood Hazard Area Inundated by the 100-year Flood
is located at an elevation of 859.6 feet above Mean Sea Level, as determined by the WDNR on
09.29.1995_ The Zoning Administrator's determination is necessary only when no official Base Flood
Elevation is available. The 100-year flood plain boundary is shown by the red line on the enclosed aerial
photo map.
In regard to your request for determination of Wetlands Status, I have reviewed the official maps and digital
mapping tools available to the Dane County Zoning Division. It appears there are no Wetlands on the three
contiguous, easterly parcels (0907-032-8020-0, 0907-032-8000-4, 0807-031-8610-7). However, the separate,
westerly parcel (0907-032-8610-7) appears to include considerable Wetlands. The Wetlands area and
boundaries are shown on the enclosed aerial photo map by the green textured shading. If your client plans to
develop this parcel, s/he must:
A) Provide a Wetlands Boundary Delineation prepared by a professional consultant;
B) Maintain a 75 foot setback from the delineated boundary as per Section 11.06(5) of the Dane
County Code of Ordinances;
C) Contact the US Army Corps of Engineers for information regarding their jurisdiction over
Wetlands.
210 Martin Luther King Jr. Blvd s Room 116, GtyCounty Bldg. •: Madison, WI 53703-3342 41 Phone. 608_266.4266 ❖ Fax: 608.267.I540
