Your letter of March 6, 2007 also asks for "Dane County's setback requirements for new and existing <br />construction. Since no detailed, scaled site plans were submitted showing existing or proposed construction, it <br />is difficult to answer such a general question. I have enclosed printouts from Dane County's Access Dane <br />property listing records, with the Zoning Districts of the four parcels in question highlighted. As you can see, <br />a total of five (5) zoning districts are represented. Each district has separate requirements — please see the <br />general table describing some of the applicable requirements, enclosed. In addition to standard setbacks from <br />roads, and standard side and rear yard setbacks for each district, the parcels in question will also have setbacks <br />from the Ordinary High Water Mark of Fish Lake, the Wetlands boundary, where present, and from any <br />zoning district boundary that is not also a property line. To complicate matters further, some exceptions to the <br />standard setbacks may apply. Therefore I cannot answer this request definitively, as presented. <br />Because you have waited so long, without response, for the answers to your questions, and because it is within <br />your client's power to find the OHWM and Floodplain information you seek, I am returning your Trust Check <br />#005068 for $150.00, dated April 7, 2006. <br />Please call me or email me if you wish to discuss this matter further.
