CONRAD <br />(608) 260-2483 <br />pconrad@axley.com <br />Thank you for meeting with me on July 30, 2008 to help to determine the status of the Mount <br />Vernon Hills II, LLC ("Mount Vernon Hills") property located in the Town of Springdale. The <br />purpose of this letter is to recap that meeting. <br />The meeting began by you explaining that there are three parcels owned by Mount Vernon that <br />were created after the adoption of the Dane County Land Division Ordinance without a certified <br />survey map. Consequently, Dane County considers thoses parcel nonconforming. The parcels <br />were identified as PARCEL III and PARCEL IV as described in R12073/51 and the small <br />remnant triangular lot adjacent to County Highway G that likely came from the Kahl property <br />west of County Highway G. <br />We then discussed what we could do to bring this property into conformance, and we determined <br />that there were two ways to accomplish that. First, we could have a certified survey map of the <br />entire property, excluding the platted lots owned by Mount Vernon Hills. The other option is to <br />record a quit claim deed with metes -and -bounds legal description that encompasses the entire <br />property owned by Mount Vernon Hills. It is my understanding that if we use the quit claim <br />deed method, we can still separately convey the platted lots owned by Mount Vernon Hills <br />without the need for a plat or certified survey map, assuming the State legislature did not vacate <br />the plat of Vernon Hills with Byam's Addition.
