AXLEY BRYNELSON, LLP
July 30, 2008Ju1y 31, 2008
Page 2
We also discussed whether the partial vacation by the State legislature of the plat of Mount
Vernon with Byam's Addition affected the lots owned by Mount Vernon Hills. You indicated
that you and the County Surveyor were researching this issue in order to verify that these lots
had not been vacated. No definite conclusion had been reached. However, at this time it appears
that these lots are still validly existing platted lots. We agreed that if these are validly existing
platted lots, which have not been vacated, they can be individually separated and sold. It is also
my understanding that the research will continue in order to make a definite determination on
whether these lots were vacated. The County Surveyor is going to supply me with a copy of the
vacation documents.
Again, thanks for meeting with me today. I appreciate the assistance in this matter. If I have
mischaracterized any part of our meeting, please let me know so that I can make sure that we are
on the same page. If you have any questions regarding this issue, please let me know.
Sincerely,
AXLEY BRYNELSON, LLP
Peter J. Conrad
PJC:egt
cc: Mr. John C.
