Scribner, Norb
To: tiffany olson
Subject: RE: Walking/Trail easement
I will attempt to again respond to the questions that you have identified. Please refer to the letter of December 15,
2006. The land parcels in question were created without the required Dane County certified survey map
approval. S.75.17(1)(a), Dane County Code of Ordinances has required this approval since May 21, 1970. The
individual(s) that you bought this property from clearly violated S.75.17(1)(a), Dane County Code of Ordinances.
It is certain that the individual(s) that you bought this property from have a legal obligation to correct this problem
for you. I cannot correct this problem for you. As indicated to you previously, there is no provision in the Dane
County Code of Ordinances for a walking trail easement. It is not legally possible for Dane County to approve a
walking trail easement without an ordinance that provides for a walking trail easement.
S.75.19(6)(b), Dane County Code of Ordinances requires every lot to front on a public street.
You are again advised to obtain legal counsel to follow proper procedure to require the seller(s) to correct this
problem.
Thank you for your anticipated cooperation in this matter.
Norbert Scribner, Dane County Land Division Review
Original Message
From: tiffany olson [mailto:tmonwi@yahoo.com]
Sent: Wednesday, September 17, 2008 5:40 PM
To: Scribner, Norb
Subject: Fw: Walking/Trail easement
Mr. Scribner:
Could you please answer the questions I posed over a week ago? I really
am in desperate need of some answers or if you don't have them, where I
could go to get them besides my attorney?
Thank you.
Tiffany Olson
Forwarded Message ----
From: tiffany olson <tmonwi@yahoo.com>
To: "Scribner, Norb" <Scribner@co.dane.wi.us>
Sent: Tuesday,September 9 2008 5:1 2 p 3 4 PM
Subject: Re: Walking/Trail easement
I do not want legal advice. What I need to know (by Dane County
Codes/Ordinances) what we can do to get this easement approved? Dane
County ordinances are what we have to follow, this is why I am seeking your
knowledge on the Dane County Codes/Ordinances on this matter.
Is there anyway we could get a variance to have this easement legal'? We do
not want a driveway easement, so 66 feet of frontage shouldn't be an issue. We
just want a walkway/access easement to be approved, so we can get a CSM
approved, in turn having a legal parcel.
9/18/2008
