Except as <br />more than one (1) <br />except for Tots in the <br />business districts. In <br />one (1) building is <br />permitted for any single business or commercial <br />enterprise. In a residence district, more than one (1) <br />accessory building is permitted, however, the total <br />floor area of the accessory building or buildings <br />shall not exceed 50 percent (50%) of the floor area <br />of the residence. On Tots in the A-1 Agriculture <br />District where the principal use is residential, more <br />than one (1) accessory building is permitted, <br />however, the total floor area of the accessory <br />building or buildings shall not exceed that of the <br />residence on the lot. On land in the A-1 Agriculture <br />District used for agricultural purposes, agricultural <br />accessory buildings are permitted but are limited to <br />barns, sheds, silos and the like that are necessary to <br />an agricultural use. <br />(2) Height. No building or structure shall be <br />erected, nor shall any existing building or structure <br />be removed, reconditioned, added to or structurally <br />altered to exceed in height the limit established by <br />this ordinance for the district in which that building <br />or structure is located. <br />(3) Percentage of lot occupancy. No building or <br />structure shall hereafter be erected, nor shall any <br />existing building be moved, altered, enlarged or <br />rebuilt, nor shall any open spaces surrounding any <br />building or structure be encroached upon or <br />reduced in any manner, nor shall a greater <br />Page 10-10 <br />rev. 103198 <br />percentage of lot be occupied, except in conformity <br />to the building site requirements and the area and <br />yard regulations established by this ordinance, for <br />the district in which such building is located. <br />(4) Density of population. No building, structure <br />or premises shall be erected, occupied or used so as <br />to provide a greater density of population than is <br />allowed by the terms of this ordinance for the <br />district in which such building, structure or <br />premises is located. <br />(5) Open space limitations. No yard or other <br />open space provided about any building or <br />structure for the purpose of complying with the <br />regulations of this ordinance shall be considered as <br />providing yard or open space for any other building <br />or structure. No lot area shall be so reduced or <br />diminished that the yard or other space shall be <br />smaller than prescribed by this chapter. <br />10.045 NCO NOISE CONTROL OVERLAY <br />DISTRICT. (1) Statement,of purpose. The purpose <br />of the Noise Control Overlay District is to effect and <br />accomplish the protection and enhancement of the <br />quality of residential life in Dane County by <br />restricting residential development adjacent to noise <br />producing areas. <br />(2) Authority. This section is enacted under s. <br />59.69, Wis. Stats., and section TRANS 405.05(2), <br />Wis. Admin. Code. <br />(3) Designation. All lands subject to this <br />ordinance lying within 200 feet of a divided <br />highway as defined in s. 340.01(15), Wis. Stats., are <br />hereby designated as subject to this section. The <br />county board may add other lands from time to <br />time. Lands subject to this section shall be <br />designated by attaching the suffix "NCO" to the <br />zoning district in which the lands are located. <br />(4) Protection. No residential dwelling shall <br />hereafter be erected in any area designated as part <br />of the Noise Control Overlay District. The <br />designation "Noise Control Overlay District" shall <br />not otherwise affect the uses to which such lands <br />may be put by the underlying zoning district. <br />(5) Exceptions. (a) The designation "Noise <br />Control Overlay District" shall not apply to lands <br />zoned for residential use prior to May 1, 1992. <br />(b) The Noise Control Overlay District shall not <br />apply to lands on which noise control barriers have <br />reduced the noise level from traffic to 67 decibels <br />or less. <br />(6) Variances. The board of adjustment is <br />empowered to remove the "Noise Control Overlay <br />District" from lands to which it -applies whenever <br />the Wisconsin Department of Transportation <br />
