Trachtenberg <br />Direct Line (608) 268-5575 <br />Facsimile (608) 257-2508 <br />rtrachtenberg@murphydesmond.com <br />We understand that the action of the Plan Commission to place on file the preliminary <br />request of Mr. and Ms. Vang to rezone Lot 3, CSM 3667, Town of Pleasant Springs (but <br />providing them 180 days to file a new preliminary request without paying a new application <br />fee) will be considered by the Town Board at its meeting on Wednesday, February 22, 2006. <br />Mr. Vang will attend the Town Board meeting simply to monitor the action of the Town <br />Board. Mr. and Ms. Vang will be submitting a revised preliminary zoning request within the <br />180 day period which we believe will be consistent with the Plan Commission's comments <br />of January 11, 2006. However, we did want to clear up two items, those being the location <br />of the easement serving the Vang property as well as whether or not the Vang parcel is a <br />legally existing parcel. <br />The Vang parcel was created by Certified Survey Map 3667 (document number <br />1700857) which was recorded in the Office of the Dane County Register of Deeds on <br />March 25, 1981. A copy of that Certified Survey Map is enclosed herewith. The Vang <br />parcel is Lot 3 of that Certified Survey Map and consists of 29.86 acres of land. In 1981, <br />parcels 15 acres or more could be created without having direct highway street frontage of 66 <br />feet as long as there was an easement to the otherwise landlocked parcel. Please note that <br />Norb Scribner approved Certified Survey Map 3667 thereby acknowledging that Lot 3 of <br />that Certified Survey Map was in fact legally created. Please also note that under present <br />Dane County ordinances, such "landlocked" parcels must be at least 35 acres in size to be <br />legally created, but the 15 acre rule did not become the 35 acre rule until 1997. Therefore, <br />the Vang parcel is a legal pre-existing nonconforming parcel. <br />In 2004, the owner of Lot 1 of Certified Survey Map 3667 desired to subdivide that <br />lot. That subdivision was accomplished by Certified Survey Map 11192, document number <br />
