1-5 <br />. During said twenty five year period it is agreed that no wind .mill be constcuted upon <br />said lots or any lot in said plat and that no barn or outhouse or garage shall be constructed upon <br />Written <br />said plat or any lot in the plat, without',,cons ent of the party of the first part as to its nee ess- <br />ity f and location. <br />Second: party of the second part, in consideration of the foregoing, hereby agrees to pay <br />to the party of the first part, in addition to the payment aforesaid, the further sum of <br />twenty nine hundred dollars ($2900. oo) at the time or times and in the ,canner following, to -wit; <br />=900. oo on before June 1st. 1922 6500. oo on or before Jany lst. 1923; $500. oo on or before July <br />1st. 1923, J�1000.00 on or before Jany lst. 1,024 with -interest upon each of said deferred paywents <br />at the rate of 6 six per cent per annum, payable annually; and further agrees to pay all taxes <br />and assessments general or special, which way be hereafter assjssed or levied on the premises <br />above deserbed, previous to the day appointed by or according to law for the sale of such land <br />for taxes or ass essm.ents , the taxes for the year 1922 to be paid by the party of the second part <br />and party of the second part Furth-er agrees not to coi"wit or suffer to be coiuuitted any waste <br />or damage upon said prewises. <br />Third: The tiu es of payment above mentioned are of the essence of this agr eew ent, and in case <br />party of the second part shall fail to make any'such paywents at the time agreed on or within:. <br />thirty days thereafter, or shall fail to pay the taxes or assesswencs as aforesaid, or shall <br />otherwise breach this agreement, party of the second part shall, at the option of the party <br />of the first part, be deemed to have abandoned and given up to the party of the first part all <br />right, title and interest in and to the above described prewises. and to any payments which <br />shall have been wade hereunder and all the right -of action upon or growing out of this agreement <br />Fifth: the covenants and agreements herein contained shall inure to the benefit of and be <br />binding upon the respective parties hereto, and their successors, heirs, personal representative <br />and assigns. <br />In witness whereof party of the first part has caused these presents to be signed by its <br />president and countersigned by its secretary, and has caused to be affixed hereto its corporate <br />seal, and party of the second part has hereunto set their hands and seals this 'lath day of may. <br />1922.
