The Neighborhood Association's
proposed conditions were found to be best addressed by means other than imposing
conditions on the zoning petition.

To best address the issues, the Neighborhood Association, Town of Madison, and the
Alexander Company, agreed to form and participate in a "Task Force" to institute plans
to achieve their goals. This task force would follow the suggested policies found in the
proposed Southdale Neighborhood Plan (draft version dated July 2, 2008).

Below is the list of conditions proposed by the Southdale-Rimrock Neighborhood
Association and Zoning Staff's response.

Requested Southdale-Rimrock Neighborhood Conditions

1. COMMUNITY BENEFITS AGREEMENT

1. that the Alexander Company and the SRNA agree to negotiate a legally-enforceable contract

setting forth community benefits to be included in the redevelopment.

Staff response: The Southdale-Rimrock Neighborhood Association is not an existing
legal entity. Corporation Counsel raised concerns on the legitimacy of contract with a
party that had no formal organizational structure.
