shall have free and unrestricted access across said Easement Area. The right to use of said <br /> Easement Area shall be an appurtenance to each respective Lot for the purposes of ingress and <br /> egress to and from the property owned by the Lot Owner. <br /> 2. Construction of Driveway. Bowar has constructed a gravel driveway n the Easement <br /> Area pursuant to applicable Town of Cross Plains standards and which complies 'th applicable <br /> Town of Cross Plains provisions at the point of access onto Mineral Point Road. owar shall be <br /> responsible for installing a blacktop surface over the Easement Area, at Bowar's xpense, at such <br /> time as the houses on Lots 1,2, 3, and 4 have been completed, or four(4)years fr m the date of <br /> this Driveway Agreement,whichever occurs first. <br /> 3. Use. There shall be no parking of vehicles or equipment or installation of gates and <br /> fences in the Easement Area or any other obstruction or growth allowed which w uld obstruct use <br /> of the Easement Area. No Lot Owner shall do any act which would interfere with the other Lot <br /> Owners' use of the Easement Area. There shall be permanent,unimpeded access the Lots <br /> served by this Driveway Agreement for emergency service responders, utility se . ces, and other <br /> access which could be had by a public road. <br /> 4. Repairs and Maintenance. Lot Owners shall maintain the Easement rea, including, <br /> but not limited to removing snow and ice,mowing the grass and,when necessary,resurfacing the <br /> Easement Area. The Easement Area must be maintained to provide adequate acc ss to emergency <br /> vehicles, school buses, and other equipment as determined by the Town of Cross Plains engineer, <br /> local fire department,and EMS service. All expenses of maintaining and repairing the Easement <br /> Area shall be shared equally by the Lot Owners,their heirs,personal rcpresentativ s, successors, <br /> and assigns. The decision as when to repair and/or maintain the existing surface f the Easement <br /> Area shall be by the agreement of at least two (2)of the Lot Owners,which decisi n shall be <br /> controlling upon all Lot Owners. In the event the Lot Owners fail to adequately aintain the <br /> Easement Area,the Town of Cross Plains and/or Dane County,at their sole discretion, shall have <br /> the right to inspect and conduct repair work on the Easement Area at the expense of Lot Owners. <br /> 5. Retention Pond. All Lot Owners shall be equally responsible for ma' tenance of the <br /> in <br /> Retention Pond located in the Easement Area, including, but not limited to keepin the area <br /> mowed. <br /> 6. Dedication of Road. The Lot Owners,their heirs,personal representa 'ves,assigns, <br /> and successors consent to the dedication of the Easement Area as a town road at y time the <br /> Town of Cross Plains, in its sole discretion, accepts it. <br /> 7. Building Setback. All buildings constructed on the Lots shall be subj ct to Dane <br /> County setback requirements measured from the Lot boundary line bordering the cement Area. <br /> -2- <br /> II <br /> III <br />
