FROM : JOHNSON AND JOHNSON PHONE NO. : 6088737521 Oct. 21 1998 01:58PM P2 <br /> October 21, 1998 <br /> Memo to: Town of Pleass nt Springs <br /> Milwaukee Repeater <br /> Mr. Steve Grc hmann <br /> and Intere•led Parties <br /> Atty.David Gault,of the'Dane County Corporation Counsel's Office,has stated that it is the opinion of <br /> their department that rem wing a permanent easement is outside the boundaries of responsibility of county <br /> government. <br /> The procedure that we ha we been directed to follow is this: An application for amendment is received <br /> from the petitioner(T bell:ve this has been received); the Zoning and Natural Resources Committee holds <br /> a public hearing(we have held one); action is taken by the Committee; County Board makes the final <br /> decision on whether to re'eat the decision on the deed restriction. <br /> It has further been stated by Corporation Counsel that it is their legal opinion that Ordinances and <br /> enabling statutes do not allow Towns to act further. Of course,the Town of Pleasant Springs should <br /> consult with their own as orney. <br /> In effect,the removal of i deed restriction does not affect the rezoning.
