Celebrate Wisconsin on <br /> the Ice <br /> MEMO <br /> 4-9-99 <br /> TO: WHOM IT MAY CONCERN <br /> FROM: CHRISTINE THISTED, ICE AGE PARK&TRAIL FOUNDATION, INC. 0 <br /> RE: USE OF FOUNDATION ACCESS EASEMENT ON BRUENIG LAND <br /> Between 1991 and 1993 the Ice Age Park and Trail Foundation purchased 80.5 acres from Leslie and <br /> Peggy Ballweg between Ballweg Road and Bruenig Road in the Town of Roxbury. This property <br /> includes an upper and lower farm field as well as some wooded portions. <br /> Access to the upper field is by a 3/4 mile long farm road from Bruenig Road that is located on land <br /> currently owned by Allan G. and Lori Bruenig. The Foundation has an 16.5 foot-wide access easement <br /> in the vicinity of the north boundary of the Bruenig property along an existing work road. This easement <br /> is solely to provide ingress and egress for the Foundation parcel from Bruenig Road for the use of: <br /> A. Agricultural tenants of the Foundation who lease the Foundation parcel for raising crops;and <br /> B. The Foundation and its successors for constructing and maintaining the Ice Age National <br /> Scenic Trail, and for stewardship activities in the Trail corridor. <br /> The 80.5 acres and corresponding access easement were purchased in part with a grant from the State <br /> Stewardship Program and in part by selling a right of first refusal to Dane County. Private funds raised <br /> by the Foundation were also used. <br /> The fact that public dollars were used in part to fund the purchase requires that the public have access to <br /> the property for purposes of the Ice Age National Scenic Trail including hiking, snowshoeing and bird <br /> watching. This access is available from Ballweg Road. <br /> Motorized traffic, except as necessary for farming, or construction or maintenance of the Trail is strictly <br /> prohibited on the property including the access easement. Foot traffic however, is permitted on the <br /> property, but public access is not permitted on the 16.5 foot easement. <br /> The Foundation wishes to manage the property for passive recreation by the public and hopes to <br /> incorporate the propem into the route of the Ice Age National Scenic Trail in the future. The Foundation <br /> also wants to maintain good relationships with area landowners. In order for this to be possible,the right <br /> of the Foundation to restrict public access on the easement must be strictly enforced.
