• I <br /> maintenance, and erosion control . <br /> Property Boundary Line Legalities -- On-site inspection <br /> of the Petition 7409 property reveals 1 ) inaccurate property <br /> line fences along the entire length of the proposed driveway <br /> (based on Survey 002398, recorded 01 /05/99 ) , and 2 ) problems <br /> along existing line fences of at least two adjacent farm <br /> owner-operators -- problems recently exaberated by current land <br /> management practices on the Petition 7409 property which, <br /> incidentally, is being farmed by the petitioners . <br /> (Eighty acres of Ice Age Trail land plus access easement <br /> to those acres also adjoin and/or overlap the Petition 7409 <br /> property. The high-quality Ice Age Trail experience intrinsic <br /> to this segment of the corridor would be sadly diminished by <br /> the inevitable effects of granting approval for Petition 7409. ) <br /> Obviously, prior to any change in zoning, establishment of an <br /> accurate boundary line, including placement of line fences and <br /> culvert( s) is a basic essential, beneficial to all involved <br /> landowners -- including the petitioners -- for resolving present <br /> problems and for alleviating future problems . <br /> PROCEDURAL CONSIDERATIONS - In addition to the legal, technical, <br /> and public cost driveway issues, procedural irregularities seem <br /> to be associated with Petition 7409 . Puzzling inconsistancies <br /> include (but are not limited to) approval of the Petition by <br /> the Town of Roxbury, in clear conflict with numerous objectives <br /> and policies, as plainly stated in the Roxbury Land Use Plan, <br /> pages 3-4 . Copies are enclosed for your convenience. <br /> Also enclosed find copies of three pertinent Roxbury Land Use <br /> Plan maps. On each map, the red-circled arrow points to a <br /> red-circled dot marking the proposed house location for Petition <br /> 7409 . The dots were located by a long-time neighboring farm <br /> owner operator -- no doubt you can pinpoint the spot more <br /> precisely. However, assuming reasonable accuracy in the marked <br /> location, note that the proposed house is sited: <br /> a) on farmland designated "prime" or "of statewide <br /> significance" by the SCS. (See enclosed Soil Productivity <br /> Classification Map. ) <br /> b) on soil designated "severe" for spetic tank drainage <br /> fields. (See enclosed Soils Limited for Septic Tank <br /> Absorption Fields Map. ) <br /> c) on a steep slope with already existing signicant <br /> eroision ditches. The steep slope combined with the <br /> "severe" septic drainfield soil cause additional concerns <br /> about downslope water pollution. (See enclosed Water <br /> Resources Map. ) <br /> SUMMARY - I believe that granting Petition 7409 is clearly <br /> inconsistant with at least 15 -- possibly 17 -- Agricultural <br /> District Policies/Town Land Use Objectives, as per the Town <br /> of Roxbury Land Use Plan, pages 3-4 .
