DANE COUNTY PLANNING AND DEVELOPMENT DEPARTMENT <br /> SUPPLEMENTAL STAFF REPORT <br /> Petition No. 7370—Halverson Work Meeting Date:Tuesday, 11/10/98 <br /> The information contained in this report is intended to act as a supplement to information provided in this <br /> petition's original staff report prepared for the 10/27/98 ZNR public hearing. A map of the subject area is <br /> included here as Attachment A. <br /> L Remaining Splits <br /> • <br /> The density study(Attachment B) associated with this petition indicates that the original farm at the time <br /> the town land use plan was adopted on August 15, 1981 was 135.69 acres. According to the town land use <br /> plan,this acreage would allow 4 splits: 135.69/35 =3.88;the town has a rounding policy;so the resulting <br /> number was rounded up to 4 splits. The density study indicates that there previously have been three splits <br /> from the original farm — per CSMs 6454, 8698, and 2099 — leaving one split yet to be used. However, <br /> CSM 2099 was recorded on July 20, 1976,prior to adoption of the town plan, so this CSM does not count <br /> toward the splits. CSM 8698 was for the original Strang farmstead: Although not stated in the town land <br /> use plan,the town of Black Earth has established the policy precedent of not counting CSMs of the original <br /> farmsteads against the splits allowed from the original farm. Based on this reasoning,the town has stated <br /> that they believe there to be three splits remaining on the Halverson property(Attachment C). <br /> To further complicate matters, there is also the issue of the Turk property to the south to which the <br /> Halversons plan to join Parcel B. The Town Chair has verbally indicated to Department of Planning and <br /> Development staff that the Turks intend to convey a split(i.e. a potential building site)to the Halversons. <br /> IL Access Road <br /> In regard to access, the Town Chair has verbally indicated that he does not favor the Committee's model <br /> private road agreement. According to the Town Chair, there are two alternatives that would be more <br /> desirable to the town than allowing the private road to operate under the Committee's model agreement. <br /> The most desirable option for the town would simply be to allow access via a private road, independent of <br /> the Committee's model road agreement. An option more desirable to the Town Chair than the former and <br /> less desirable than the latter would be to make this access road into a public, town road. Since the Town <br /> Chair does not favor the Committee's model private road agreement, and the Committee is not likely to <br /> favor a private road without an established maintenance agreement, it seems as though a possible <br /> compromise would be to create a public town road.
