'15. No chemical additives are to be used with the water used for washing aggregates or <br /> dust control. <br /> 36. The Operator shall implement the revised spill prevention and counter measure <br /> plan dated March 16, 1998 and submitted to Dane County' on March 18, 199S. <br /> The spill prevention and counter measure plan shall apply to all operations on the <br /> site including subcontractors and suppliers. <br /> 37. The fugitive dust control plan dated and submitted April 15, 1998 shall be <br /> implemented by the Operator. <br /> 38. The Operator shall meet DNR standards for particulate emissions as described in <br /> NR415.075 and NR415.076 IVisconsin Administration Code. <br /> 39. The groundwater monitoring plan submitted on April 15, 1998 to Dane County shall <br /> be implemented by the Operator. <br /> 40. The settling pond shall be periodically cleaned of accumulated sediment, and that <br /> sediment returned to the excavated areas on site. <br /> 41. The "Well, Septic, and Basement Clause" revised April 15, 1998 and submitted to <br /> Dane County on April 15, 1998 shall be implemented by the Operator, including <br /> providing the bonds of S15,000.00 for well & septic and 510,000 for basements, as <br /> stated in the clauses. <br /> 42. The area north of Badger Mill Creek shall be designated a "buffer area" as - <br /> designated on the plans. No mineral extraction shall take place within the "buffer <br /> area". Mineral extraction shall not take place within the 100' set-backs, or within a - <br /> flood plain, mapped wetland, or within 500' of Badger Mill Creek. <br /> 43. In the event that a decrease in the groundwater base flow to Badger Mill Creek is <br /> determined by the Wisconsin DNR to have occurred, and the Wisconsin DNR <br /> determines the decrease in flow is a direct result of the operation of C.U.P. 1484, the <br /> Operator of C.U.P. 1464 agrees to replenish the lost flow volume with approximately <br /> 60' F water from the pond, a well, or other means mutually agreeable to the <br /> Wisconsin DNR and the Operator. <br /> 44. The Operator shall follow all aspects of the site/operational plans submitted. <br /> 45. The Operator shall apply for, receive, and maintain all other required Iocal, state, <br /> and federal permits. <br /> 4 <br />
