dwellings with basements and the installation of septic systems due to shallow soil depth(16"to <br /> 30") over dolomite bedrock. <br /> A small natural drainageway, apparently non-navigable, appears to run diagonally from <br /> southeast to northwest across the center of the existing building lot(CSM 8479 Lot 1). The <br /> Wisconsin Wetland Inventory shows no wetlands on or near the site. <br /> IV. COMPLIANCE WITH COUNTY ORDINANCES <br /> The RH-2 district allows single family residences on lots not smaller than 4 acres. This zoning <br /> would be appropriate for the intended uses of Lots 2 and 3. <br /> As proposed,the north corner of the 4.21 acre lot(Lot 2 on the draft CSM), would be five feet <br /> from the Verona—Middleton town line. This is intended to provide an access connecting the <br /> eastern and western portions of Lot 1. Since the applicants own land on both sides of the town <br /> line, this irregularity will not likely cause immediate difficulties,but could pose problems if the <br /> land is ever sold. Although not specifically dictated in ordinance or statute, normal practice <br /> would be to either provide a normal 66-foot wide easement or to close the gap by tying the lot <br /> corner to the town line, splitting Lot 1 into two separate parcels. If the latter option is chosen, <br /> the eastern portion of Lot 1 would not meet the 8 acre minimum lot size required for RH-3 <br /> zoning. <br /> The applicants have requested RH-3 zoning with the intent of using Lot 1 as a private prairie <br /> preserve. In discussions with staff,the applicants' agent has indicated that the landowners chose <br /> RH-3 zoning because they would like to retain the option of residential development in the <br /> future. Although a nature preserve could be considered incidental to other permitted uses in an <br /> RH-3 district, any such use, including future residential development, would be precluded by the <br /> Town of Verona's density policy, as noted below. Given this restriction and the potential conflict <br /> with RH-3 minimum lot sizes, CO-1 Conservancy zoning would seem more appropriate. <br /> V. COMPLIANCE WITH ADOPTED PLANS <br /> The proposal would create one new building lot, and would effectively remove deed restrictions <br /> prohibiting development on an adjacent lot, potentially creating a total of two new building sites. <br /> This would conflict with the Town of Verona Land Use Plan,which sets a maximum density of <br /> one unit per 35 acres in agricultural preservation areas. In 1980, when the plan was adopted,the <br /> proposed site was part of a 131-acre farm, allowing a total of 3.7 splits. Since then, a total of 6 <br /> splits have occurred, in apparent violation of plan policies. Staff recollect that this was the <br /> rationale for the imposition of deed restrictions on adjoining land in the Town of Middleton as a <br /> condition of approval for Petition# 6658. <br /> According to the Dane County Parks and Open Space Plan,the entire property is within the <br /> mapped corridor for the planned Ice Age Trail. <br /> VI. PUBLIC, LOCAL GOVERNMENT AND AGENCY INPUT <br /> The Regional Planning Commission has noted that the proposal conflicts with the Town of <br /> Verona's density policy, as indicated above. At the time of this writing, no other county agency <br /> had commented on the application, and the position of the Town of Verona was not known. <br />
