Smiley, Director <br /> Community and Regional Deve • 'ment Planning <br /> DATE: December 30, 1997 <br /> RE: Response to Kendall Kahl's Comments of December 16, 1997 <br /> Regarding Zoning Petition #7106 <br /> At the public hearing, Mr. Kahl submitted comments which indicated disagreement with RPC <br /> staff comments on Petition 7106 in the Town of Berry. I have prepared "Corrected Comments" <br /> to acknowledge any error, and this memo will discuss the rationale and the issues related to his <br /> comments. <br /> 1. There is no real disagreement on the farmland. The policy criteria speaks to "where <br /> farming has not been economical." This area is a hayfield and it is a judgment call whether <br /> fanning has been economical. <br /> 2. The 100 acres is an error. The area is approximately 80 acres as noted by the applicant. <br /> The notation with regard to the creek and wetland crossing the southwestern parcel is correct. I <br /> have checked the official maps used by Zoning staff in administration of the County Shoreland- <br /> Wetland Ordinance. Zoning staff concurs that there is a wetland area along the creek which <br /> crosses the southern end of this proposed parcel. Whether or not it was tiled, it is a recognized <br /> wetland and may have to be rezoned out of the Shoreland-Wetland Zoning to allow filling and <br /> grading. <br /> 3. In discussing parcel sizes with the applicant, I find that we are working off two different <br /> plans. The county's adopted plan for the Town of Berry has the provision: "The minimum lot <br /> size shall be between two and ten acres." This is found in paragraph 4 on page 6. <br /> However, the applicant notes that this provision was amended by the Town of Berry in <br /> 1988. The amended version reads: "The minimum lot size shall be 2 acres or more." <br /> We have no record that this plan amendment was ever received or reviewed by the <br /> county. Thus, the 1981 version of the plan applies as county policy until the amended language <br /> is submitted, reviewed and adopted as part of the Dane County Farmland Preservation Plan. <br /> RPC <br />
